4 <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that <br />this Council hereby authorizes the City Manager, or his designee to sign the following <br />documents, in form approved by the City Attorney: <br /> <br />Agreement for the purchase and sale of real property with the estate of Elizabeth <br />Wheeler and its residuary beneficiaries for the permanent easement area located <br />on the rear 45% of the property located at 407 East High Street, for a purchase <br />price of $150,000.00 <br /> <br />The City Attorney is authorized to endorse the deed to said easement to evidence the <br />City's acceptance of the conveyance <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that <br />this Council hereby authorizes the City Manager, or his designee to sign the following <br />documents, in form approved by the City Attorney: <br /> <br />Commercial lease agreement with the Roy Wsheeler Realty Company, Inc. for the <br />building and premises at 401 East High Street for a period of approximately three <br />(3) months beginning October 1, 2004, for a monthly rent of $3,500.00; and <br /> <br />Agreement for the purchase and sale of real property with Roy Wheeler Realty, <br />Inc. for the building and premises at 401 East High Street, for a purchase price of <br />$770,000.00, with closing as soon as practicable after January 1, 2005. <br /> <br />PUBLIC HEARING/ORDINANCE: CHANGING TIME OF REGULAR COUNCIL <br />MEETINGS TO 7:00 P.M. (OR EARLIER) (2nd reading) <br /> <br /> Dr. Brown said that Council has been considering the issue of beginning its <br />regular meetings earlier to benefit the public and media, and has discussed conducting <br />business in a more timely fashion. <br /> <br /> The public hearing was opened, but as there were no speakers, the public hearing <br />was closed. <br /> <br /> Mr. Lynch said moving the meetings to an earlier time is a good idea, and he feels <br />that 7:00 p.m. is a reasonable time, though he had hoped to hear a groundswell of support <br />for beginning even earlier. <br /> <br /> The ordinance entitled "AN ORDINANCE AMENDING AND REORDAINING <br />SECTION 2-41 OF ARTICLE II OF CHAPTER 2 OF THE CODE OF THE CITY OF <br />CHARLOTTESVILLE, 1990,A S AMENDED, TO ESTABLISH 7:00 P.M. AS THE <br />TIME FOR REGULAR MEETINGS OF CITY COUNCIL," which was offered at the <br />September 7th meeting, was approved by the following vote. Ayes: Dr. Brown, Mr. <br />Caravati, Ms. Hamilton, Mr. Lynch, Mr. Schilling. Noes: None. <br /> <br />PUBLIC HEARING/ORDINANCE: WATER PROTECTION ORDINANCE (2nd <br />reading) <br /> <br /> Ms. Mary Joy Scala, Planner in Neighborhood Development Services, <br />summarized the main items in the Water Protection Ordinance. She said that notice has <br />been provided to property owners impacted by the stream buffer provisions. <br /> <br />The public hearing was opened. <br /> <br /> Ms. Laura Covert, 1809 E. Market Street, noted that the ordinance is only the first <br />step and she urged the City to press forward to include smaller streams. She questioned <br />whether Neighborhood Development Services will be able to handle the greater demand <br />on staff, and suggested that a new department be created that will focus on conservation <br />rather than development. <br /> <br /> <br />
