required by Section 15.2-4907 of the Act have been filed with the Council of City of Charlottesville, <br />Virginia; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CITY OF <br />CHARLOTTESVILLE, VIRGINIA: <br /> <br /> 1. The Council approves the refunding of the Prior Bonds in order to refinance the Project, <br />and approves the issuance of the Bonds by the Authority for the benefit of the Applicant, as required by <br />Section 147(f) of the Code and Section 15.2-4906 of the Act. <br /> <br /> 2. The foregoing approval of the proposed issuance of the Bonds does not <br />constitute an endorsement of the Bonds to a prospective purchaser of the credit-worthiness <br />of the Project or of the Applicant, or the financial viability of the Project. As required by <br />Section 15.2-4909 of the Act, the Bonds shall provide that neither the Commonwealth of <br />Virginia nor City of Charlottesville, Virginia nor the Authority shall be obligated to pay <br />the Bonds, or the interest thereon, or any other costs incident thereto, except from the <br />revenue and monies pledged therefore, and further, that neither the faith and credit nor the <br />taxing power of the Commonwealth of Virginia, nor City of Charlottesville, Virginia, nor <br />the Authority shall be pledged thereto. <br /> <br />3. This resolution shall take effect immediately upon its adoption. <br /> <br />i. RESOLUTION: Authorizing Lease for Office Space at 421 Park Street <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that <br />this Council hereby authorizes the City Manager, or his designee, to sign the following <br />document in form approved by the City Attorney: <br /> <br />Commercial Lease Agreement between Gary and Beverley Garbaccio <br />(Black Sheep Holding) as Lessor and the City of Charlottesville and <br />Albemarle County, as Lessees, for a portion of the premises located at <br />421 Park Street, for a term of one year with two six-month extensions, <br />beginning October 18, 2004, for a monthly rent of $1,950.00. <br /> <br />ORDINANCE: "AN ORDINANCE TO QUITCLAIM NATURAL GAS <br />LINES LOCATED IN ROADWAYS IN THE SOUTH FOREST LAKES <br />SUBDIVISION IN ALBEMARLE COUNTY TO THE VIRGINIA <br />DEPARTMENT OF TRANSPORTATION" (2nd reading) <br /> <br />ORDINANCE: "AN ORDINANCE TO AMEND AND <br />REORDAIN CHAPTER FIVE OF THE CODE OF THE CITY OF <br />CHARLOTTESVILLE (1990), AS AMENDED (BUILDING REGULATIONS; <br />PROPERTY MAINTENANCE) TO CONFIRM LOCAL ORDINANCES <br />RELATING TO THE CONSTRUCTION, ALTERATION AND <br />MAINTENANCE OF CITY BUILDING AND STRUCTURES TO THE <br />REQUIREMENTS OF THE UNIFORM STATEWIDE BUILDING CODE AND <br />OTHER PROVISIONS OF THE LAW" (carried over) <br /> <br />PRESENTATION: DEQ AWARD FOR PARKS AND RECREATION <br /> <br /> Mr. Larry Simmons, Deputy Regional Director for the Department of <br />Environmental Quality, announced that the Department of Parks and Recreation has been <br />accepted into the Virginia Environmental Excellence Program. <br /> <br />REPORT: STATE OF PARKS AND RECREATION FACILITIES <br /> <br /> Mr. Mike Svetz, Director of Parks and Recreation, said that many existing Parks <br />and Recreation facilities are in need of renovation, both physically and programmatically. <br />He presented a power point presentation showing various sites in need of repair. <br /> <br /> Mr. Lynch said that the supposition has been that the next big capital project for <br />Parks and Recreation will be McIntire Park, but asked if those priorities are still right in <br />light of these needs. <br /> <br /> <br />
