required by Section 15.2-4907 of the Act have been filed with the Council of City of Charlottesville, Virginia; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CITY OF CHARLOTTESVILLE, VIRGINIA: 1. The Council approves the refunding of the Prior Bonds in order to refinance the Project, and approves the issuance of the Bonds by the Authority for the benefit of the Applicant, as required by Section 147(f) of the Code and Section 15.2-4906 of the Act. 2. The foregoing approval of the proposed issuance of the Bonds does not constitute an endorsement of the Bonds to a prospective purchaser of the credit-worthiness of the Project or of the Applicant, or the financial viability of the Project. As required by Section 15.2-4909 of the Act, the Bonds shall provide that neither the Commonwealth of Virginia nor City of Charlottesville, Virginia nor the Authority shall be obligated to pay the Bonds, or the interest thereon, or any other costs incident thereto, except from the revenue and monies pledged therefore, and further, that neither the faith and credit nor the taxing power of the Commonwealth of Virginia, nor City of Charlottesville, Virginia, nor the Authority shall be pledged thereto. 3. This resolution shall take effect immediately upon its adoption. i. RESOLUTION: Authorizing Lease for Office Space at 421 Park Street BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that this Council hereby authorizes the City Manager, or his designee, to sign the following document in form approved by the City Attorney: Commercial Lease Agreement between Gary and Beverley Garbaccio (Black Sheep Holding) as Lessor and the City of Charlottesville and Albemarle County, as Lessees, for a portion of the premises located at 421 Park Street, for a term of one year with two six-month extensions, beginning October 18, 2004, for a monthly rent of $1,950.00. ORDINANCE: "AN ORDINANCE TO QUITCLAIM NATURAL GAS LINES LOCATED IN ROADWAYS IN THE SOUTH FOREST LAKES SUBDIVISION IN ALBEMARLE COUNTY TO THE VIRGINIA DEPARTMENT OF TRANSPORTATION" (2nd reading) ORDINANCE: "AN ORDINANCE TO AMEND AND REORDAIN CHAPTER FIVE OF THE CODE OF THE CITY OF CHARLOTTESVILLE (1990), AS AMENDED (BUILDING REGULATIONS; PROPERTY MAINTENANCE) TO CONFIRM LOCAL ORDINANCES RELATING TO THE CONSTRUCTION, ALTERATION AND MAINTENANCE OF CITY BUILDING AND STRUCTURES TO THE REQUIREMENTS OF THE UNIFORM STATEWIDE BUILDING CODE AND OTHER PROVISIONS OF THE LAW" (carried over) PRESENTATION: DEQ AWARD FOR PARKS AND RECREATION Mr. Larry Simmons, Deputy Regional Director for the Department of Environmental Quality, announced that the Department of Parks and Recreation has been accepted into the Virginia Environmental Excellence Program. REPORT: STATE OF PARKS AND RECREATION FACILITIES Mr. Mike Svetz, Director of Parks and Recreation, said that many existing Parks and Recreation facilities are in need of renovation, both physically and programmatically. He presented a power point presentation showing various sites in need of repair. Mr. Lynch said that the supposition has been that the next big capital project for Parks and Recreation will be McIntire Park, but asked if those priorities are still right in light of these needs.
