17 <br /> <br /> Ms. Kelley said it could not be done with the deed already entered into with the <br />other property owners, it would require the applicant to go back to the private property <br />owners. <br /> <br />Ms. Hamilton asked if a perpetual easement negates the mechanical issue. <br /> <br /> Mr. Lynch made a substitute motion to approve the alley closing subject to a fee <br />of $4,038.00, and Mr. Schilling seconded the motion. <br /> <br /> Mr. Schilling said he is torn because he likes Mr. Caravati's idea, but fears <br />Council is getting on tenuous ground. <br /> <br /> The ordinance entitled "AN ORDINANCE CLOSING, VACATING AND <br />DISCONTINUING A PORTION OF AN ALLEY LOCATED OFF 10TM STREET <br />ADJOINING PARCELS 136, 137 AND 138, CITY TAX MAP 54," as amended, was <br />offered and carried over to the next meeting for consideration. <br /> <br />APPROPRIATION: $40,000 - SCHOOL FUNDED BUS AIDES <br /> <br /> Mr. Schilling said that wherever there is discretion he would prefer to spend <br />money in the classroom. He said there appear to be problems, and he would like an <br />incident report on what sort of things are happening on the buses. <br /> <br /> On motion by Mr. Lynch, seconded by Mr. Schilling, the $40,000 appropriation <br />for School Funded Bus Aides was offered and carried over to the next meeting for <br />consideration. <br /> <br />PUBLIC <br /> <br /> Mr. Peter Kleeman, 407 Hedge Street, expressed concern that he had trouble <br />downloading documents pertaining to Hillsdale Drive. He said he asked about the role of <br />VDOT and heard that VDOT has delegated authority to the City. He said there is <br />potential disaster ahead. He questioned who has the ability to review comments and <br />environmental issues. He challenged Council to promise that public comments will be <br />given consideration and responses will be provided. <br /> <br /> Mr. Lynch said he had the same trouble downloading the document. He said the <br />Steering Committee periodically gets comments, but they have not answered them <br />individually. He said the City may do the project design. <br /> <br />OTHER BUSINESS <br /> <br /> Mr. O'Connell announced that the east end mall construction has begun and 7th <br />Street will close on Wednesday. <br /> <br /> Ms. Hamilton asked about the tree, and Mr. O'Connell said that staff is looking at <br />reuse of the wood from the tree, possibly in the Transit Center. <br /> <br />Mr. Caravati encouraged everyone to vote. <br /> <br />Council reconvened in closed session. <br /> <br /> On motion by Mr. Caravati, seconded by Mr. Lynch, Council certified by the <br />following vote (Ayes: Dr. Brown, Mr. Caravati, Ms. Hamilton, Mr. Lynch, Mr. <br />Schilling. Noes: None) that to the best of each Council Member's knowledge, only <br />public business matters lawfully exempted from the open meeting requirements of the <br />Virginia Freedom of Information Act and identified in the motion convening the closed <br />session were heard, discussed or considered in the closed session. <br /> <br />The meeting was adjourned. <br /> <br /> <br />
