11 <br /> <br /> Responding to a question from Ms. Hamilton, Mr. Tolbert said that the applicant <br />has proffered two affordable units. <br /> <br /> Dr. Brown noted that the Planning Commission carefully and unanimously <br />recommended closing the streets and alley and he is inclined to support closing them <br />unless there are bigger issues to consider. He said he would approve the closings as <br />recommended. <br /> <br /> Ms. Hamilton said she sees Mr. Lynch's concern over public access to waterways <br />and feels he makes good points worth considering. <br /> <br /> Mr. Schilling said it looks like a nice project, but he has questions that have not <br />been able to be answered so he will abstain from voting. <br /> <br />Mr. Caravati said Mr. Lynch's idea is intriguing. <br /> <br /> Mr. David Toscano, attorney for the applicant, asked if the City's liability will be <br />removed if Leander is closed. <br /> <br /> Mr. Brown said that Leander Street is a dedicated unaccepted right of way and the <br />property line is at the mid-line of the stream. He said the adjoining property owners own <br />fee simple title to the center of the creek. He said he does not think the City has liability. <br /> <br /> Mr. Caravati asked if it will hinder the project is no action is taken on closing <br />Leander tonight. <br /> <br /> Mr. Toscano said there are no plans to develop that portion except for passive use. <br />He said the reason the applicant wanted to close it was to make everything cleaner. He <br />expressed concern about opening the north side of the creek to the public. He said the <br />applicant would like to create an opportunity for a bridge type structure across the creek <br />at Rialto. <br /> <br /> Mr. Caravati made a motion to close Rougemont Avenue and the alley off Rialto <br />and to defer the closing of Leander until the next meeting, and Ms. Hamilton seconded <br />the motion. <br /> <br />Mr. Lynch asked about the issue of compensation. <br /> <br />Ms. Hamilton said she thinks building a bridge is compensation. <br /> <br /> The ordinances entitled "AN ORDINANCE CLOSING, VACATING AND <br />DISCONTINUING AN ALLEY LOCATED OFF RIALTO STREET, ALONG THE <br />SOUTHERN BOUNDARIES OF PARCELS 374.1 AND 374.2 AND ACROSS <br />PARCEL 374 OF CITY TAX MAP 59" and "AN ORDINANCE CLOSING, <br />VACATING AND DISCONTINUING A PORTION OF ROUGEMONT AVENUE <br />BETWEEN RIALTO STREET AND AVON STREET" were offered and carried over to <br />the next meeting for consideration. <br /> <br />The ordinance closing Leander Street was deferred to the next meeting. <br /> <br />ORDINANCE: REZONING 701-707 PALAT1NE AVENUE (BLINCOE TRACT) <br />FROM R- 1S TO PUD <br /> <br /> Mr. Tolbert said that the request is to rezone the property from R- 1 S to PUD for <br />21 single family detached units. He said the floodway affects one third of the property <br />and 32% of the site will be open space. Mr. Tolbert said the applicant has proffered two <br />affordable units to be done in partnership with Piedmont Housing Alliance, and a trail <br />crossing from Rialto to the south side of the creek. <br /> <br /> Responding to a question from Mr. Caravati about whether there will be a new <br />street, Mr. Tolbert said that the road off Palatine toward Rialto will end in a cul de sac, <br /> <br /> <br />
