Noes: None. <br /> <br /> BE IT RESOLVED by the Council for the City of Charlottesville that the <br />City Planning Commission is directed pursuant to Ci_ty Code § 34-41 to consider, <br />following a public hearing, an amendment to the zoning district classification of <br />the property located at 217 Douglas Avenue from R-2 Residential to Planned Unit <br />Development, and to make a recommendation on the proposed rezoning to City <br />Council. <br /> <br />RESOLUTION: AUTHORIZING CITY MANAGER TO SIGN PURCHASE <br />AGREEMENT FOR 417-419 PARK STREET <br /> <br /> Mr. Lynch expressed concern that the agreement provides for 15 parking spaces <br />in the parking garage, but there is no cap on the legal fees, and suggested a cap of <br />$10,000. Mr. Lynch made a motion to that effect. <br /> <br />Mr. Brown said he thinks that is reasonable. <br /> <br /> Mr. Caravati seconded the motion and the resolution authorizing the City <br />Manager to sign the Purchase Agreement for 417-419 Park Street, with a cap of $10,000 <br />on legal fees, was approved by the following vote. Ayes: Dr. Brown, Mr. Caravati, Ms. <br />Hamilton, Mr. Lynch, Mr. Schilling. Noes: None. <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that <br />this Council hereby authorizes the City Manager, or his designee, to sign the following <br />document, in form approved by the City Attorney: <br /> <br />Agreement between the City of Charlottesville/County of Albemarle and Franklin <br />and Hay Hardy for the Purchase and Sale of a portion of 417-419 Park Street and <br />easements related to the renovation and expansion of the Juvenile & Domestic <br />Relations District Court. <br /> <br />MINUTES: NOVEMBER 4, 10, 11 AND 15 <br /> <br /> Mr. Schilling said he did not make a statement of corrections of the facts at the <br />previous meeting in response to statements by a member of the public because Council's <br />operating guidelines do not allow that. He said the statements made were factually <br />untrue, but because of the policy he did not engage the speaker or respond. After <br />speaking with the City Attorney and Mayor, he would like to request that a parenthetical <br />comment be added to the minutes of November 15th. He said the only thing you can <br />count on is your name. He said that in the future Council may need to look at the <br />guidelines, and added that he followed them to his own detriment. <br /> <br /> Mr. Lynch said he is concerned about that request. He said he understands that <br />Mr. Schilling wants to clarify the statements made, but the minutes document what we <br />said, not what we wish we had said. He said he has also wanted to respond to the public, <br />but the minutes are a representation of what was said. <br /> <br /> Mr. Schilling said there were factual errors in the statement of actions taken by <br />him. <br /> <br /> Dr. Brown asked if it is appropriate or can a parenthetical comment be added that <br />guide you to another set of minutes. He said he is personally not familiar with that being <br />done. He said that could become the process in the future and he is reluctant to go down <br />that road. Dr. Brown asked Mr. Brown if he has encountered this in the past. <br /> <br /> <br />
