asked Council to consider running both versions of the ordinance back to the BAR and <br />Planning Commission as this would overrule the Planning Commission's action. <br /> <br /> Dr. Brown said he would like to see the ordinance move ahead, noting that the <br />structures could change hands or be changed in the meantime. <br /> <br /> Ms. Hamilton made a motion to approve ordinance "B" which removes the <br />University properties from the district. <br /> <br /> Mr. Lynch seconded the motion, and said that while he respects the concern about <br />not overruling the Planning Commission's decision, this was a close decision and the <br />current agreement was not in place at that time. Mr. Lynch said that having seen the <br />properties owned by the University, he would find it a stretch to call all but one of them <br />architecturally significant. <br /> <br /> The ordinance entitled "AN ORDINANCE AMENDING AND REORDAINING <br />CHAPTER 34 (ZONING), ARTICLE I, SECTION 34-1, AND ARTICLE II, SECTION <br />34-272, OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS <br />AMENDED, TO ADD A SEVENTH ZONING OVERLAY DISTRICT TO BE <br />DESIGNATED AS THE OAKHURST-GILDERSLEEVE NEIGHBORHOOD <br />ARCHITECTURAL DESIGN CONTROL DISTRICT," (Alternate B) was offered and <br />carried over to the next meeting for consideration. <br /> <br />ORDINANCE: ZONING AMENDMENTS RE: FLOODWAYS <br /> <br /> Mr. O'Connell said that Council is being asked to approve the ordinance in one <br />reading because of a State deadline. <br /> <br /> Mr. Tolbert said that the City enacted a floodways ordinance because it makes <br />good common sense and allows residents to purchase subsidized flood insurance. He <br />explained that the State is requiring four changes to the ordinance: 1) changing the date to <br />February 4, 2005; 2) bottoms of openings of elevated buildings shall be no higher than <br />one foot above grade; 3) encroachments in the floodway allowed an increase of one foot; <br />and encroachments in the flood plain allowed to increase no more than one foot. Mr. <br />Tolbert noted that the City is appealing the elevation mapping requirements. He said that <br />the ordinance needs to be approved by February 4th. <br /> <br /> Mr. Caravati made a motion to approve the ordinance and Mr. Schilling seconded <br />the motion. <br /> <br /> On motion by Mr. Lynch, seconded by Mr. Caravati, Council voted to waive the <br />second reading of the ordinance and to approve the ordinance entitled "AN <br />ORDINANCE AMENDING AND REORDAINING SECTIONS 34-242, 34-251, 34-252 <br />AND 34-254 OF ARTICLE II, DIVISION I OF CHAPTER 34 (ZONING) OF THE <br />CODE OF THE CITY OF CHARLOTTESVILLE (1990), AS AMENDED, RELATING <br />TO FLOOD HAZARD PROTECTION OVERLAY DISTRICT REGULATIONS" by the <br />following vote. Ayes: Dr. Brown, Mr. Caravati, Ms. Hamilton, Mr. Lynch, Mr. <br />Schilling. Noes: None. <br /> <br />ORDINANCE: CLOSING LEANDER STREET (2nd reading) <br /> <br /> Mr. Caravati said that Leander Street is in the middle of the creek and if the street <br />is closed, it will be the only closure along the creek. He said he would like to keep the <br />street open so that the City can control the entire length of the creek. <br /> <br /> Mr. Schilling noted that the applicant's counsel said there was no reason to close <br />the street. <br /> <br /> Mr. Caravati made a motion to amend the ordinance to deny the street closing and <br />Mr. Schilling seconded the motion. <br /> <br /> <br />
