4 <br /> <br />Mr. Caravati said he based his motion on comments the applicant has made. <br /> <br />Mr. Brown said special permits are not subject to proffers or conditions such as <br /> <br />this. <br /> <br /> Mr. Caravati withdrew his motion and made a motion to deny the special permit <br />based on his comments. <br /> <br />Mr. Caravati's motion died for lack of a second. <br /> <br /> Mr. Lynch made a motion to approve the special permit, but added that he would <br />really like to see affordable housing included. <br /> <br /> Mr. Bruce Wardell, architect for the project, said that in this kind of development <br />affordable housing is achieved by a mix of units. He said the principle of trying to <br />provide some affordable housing is part of what they are trying to achieve. He said he <br />thinks they can accomplish the vast majority of the goal without committing to hard and <br />fast numbers. Mr. Wardell said his reading of the City's Housing Policy goals for <br />affordable housing were higher than that mentioned by Mr. Lynch. <br /> <br /> Mr. Caravati said that the applicant is voluntarily offering affordable housing, and <br />asked is there a way this can be codified. <br /> <br /> Mr. Brown said that the applicants have indicated that are willing to do <br />"something," but they are talking in generalities, and if the market conditions change it <br />cannot be enforced. <br /> <br />Ms. Hamilton seconded the motion to approve the special permit. <br /> <br /> Mr. Caravati said he will vote against the special permit because he would prefer <br />to see something more definitive, especially in this neighborhood where affordable <br />housing is such a big issue. He expressed frustration that we cannot ensure affordable <br />housing. <br /> <br /> The Resolution approving the special permit for higher density at 129 10th Street, <br />N.W. (10 Center) was approved by the following vote. Ayes: Dr. Brown, Ms. Hamilton, <br />Mr. Lynch, Mr. Schilling. Noes: Mr. Caravati. <br /> <br /> WHEREAS, pursuant to the Code of the City of Charlottesville, section 34- <br />464(1), William G. Chapman, on behalf of Tenth and Main, LLC, has requested a special <br />use permit to allow additional residential density for property located at 129 l0th Street, <br />N.W., identified on City Tax Map 10 as Parcel 39 ("Property"), which Property contains <br />approximately 29,795 square feet (0.6840 acre); <br /> <br /> WHEREAS, a public hearing on this application was conducted by the Planning <br />Commission on June 14, 2005, following notice to the public and to adjacent property <br />owners as required by law and thereafter, the Planning Commission voted to recommend <br />approval of the proposed special use permit; and <br /> <br /> WHEREAS, a public hearing on this application was conducted by this City <br />Council on July 5, 2005, following notice to the public and to adjacent property owners <br />as required by law; and <br /> <br /> WHEREAS, this application seeks approval of residential density of up to 54 <br />dwelling units per acre (54 DUA), not to exceed thirty-six (36) dwelling units; and <br /> <br /> WHEREAS, the subject parcel is currently zoned B-3 (Business District) wherein <br />residential density of up to twenty-one units per acre (21 DUA) is allowed by-right, and <br />additional density, up to 87 DUA, may be authorized by City Council through issuance of <br />a Special Use Permit, pursuant to City Code 1534-480; and <br /> <br /> <br />
