457 <br /> <br />ORDINANCE: REZON1NG CORNER OF AVON STREET AND PALAT1NE <br />AVENUE FROM R- 1 S TO PUD <br /> <br /> Mr. Brian Haluska, Planner in Neighborhood Development Services, explained <br />that the Planning Commission unanimously approved the rezoning. <br /> <br /> Mr. Caravati asked if staff is comfortable with egress and ingress, and Mr. <br />Haluska said that the City's temporary Traffic Engineer said the proposal is sufficient. <br /> <br /> Mr. Caravati asked if the speed limit was recommended to be lowered to 25 mph, <br />and Mr. Haluska said no. <br /> <br /> Mr. Lynch said we have ended up with projects that are different on the ground <br />than what was approved, and he asked staff to try to get more specificity from the <br />developer when putting plans together. He said he thinks an affordability component is <br />reasonable. He said he would like staff to try to find out what the developer can do for <br />the neighborhood when rezonings are requested. <br /> <br /> Mr. Haluska said that all applicants for rezonings are asked to speak with the <br />affected neighborhood associations. He said there is no recognition of affordability in <br />this rezoning. He said that if plans change from the conceptual plan they have to come <br />back to the City. <br /> <br /> Mr. Lynch said there is another development adjacent to this proposal, and he <br />asked if there was an attempt to get the two developers to work together on a street grid. <br /> <br /> Mr. Haluska said this was discussed, but the owners could not come to an <br />agreement other than for a grading easement. <br /> <br /> Responding to a question from Ms. Hamilton, Mr. Haluska said there are no <br />proffers associated with this rezoning. <br /> <br /> Ms. Hamilton said she is not entirely comfortable with the information provided <br />and made a motion to postpone the rezoning so that she can ask a few more questions. <br /> <br />Mr. Caravati seconded the motion to defer. <br /> <br /> Ms. Hamilton said when approving PUDs we do not have a good process to get <br />something back for the City. She said she would like to get something that is binding. <br />She said she would also like to make sure that what we are agreeing to is what actually <br />happens. <br /> <br /> Mr. Schilling noted that Ms. Hamilton's concerns seem to go beyond this <br />development. <br /> <br /> Ms. Hamilton said that is correct, and she would like to discuss it and get a better <br />process and result. <br /> <br /> Mr. Lynch agreed and said this issue comes up a lot and we should make sure we <br />are doing something for people who are already here. <br /> <br /> Dr. Brown said he is hearing that Councilors want to look more at this project, <br />and also use it to look at the greater issue. <br /> <br /> The rezoning was deferred by the following vote. Ayes: Dr. Brown, Mr. <br />Caravati, Ms. Hamilton, Mr. Lynch, Mr. Schilling.
