9 <br /> <br /> Mr. Schilling said we ought to look at the value set as the Assessor’s Office has <br />undervalued property before and he does not have confidence in the amount proposed. <br /> <br /> A representative from Qwest Communications said they are under tight time <br />constraints and noted that the City and County Assessors set the price. He said there is a <br />th <br />deadline to complete the project by January 30. He said this amount is in line or higher <br />than what most State Departments of Transportation charge. <br /> <br /> Mr. Schilling made a motion to grant the easement, but rather than 50% of the <br />value, he said we should set the price at 75% of the value. He said he thinks we are <br />looking at a low ball estimate as has been done previously by the Assessor. <br /> <br /> Mr. Lynch seconded the motion to charge a lease of $5,700 a year. <br /> <br /> The Resolution Approving the Location of Fiberoptic Cable through Towe Park <br />and Meadowcreek Golf Course, at a cost of $5,700 a year, was approved by the following <br />vote. Ayes: Ms. Hamilton, Mr. Lynch, Mr. Schilling. Noes: Dr. Brown and Mr. <br />Caravati. <br /> <br />BE IT RESOLVED <br /> by the Council for the City of Charlottesville, Virginia that <br />this Council hereby authorizes the City Manager, or his designee, to sign the following <br />documents, in form approved by the City Attorney: <br /> <br />Underground Right-of-Way License Agreement between the City of <br />Charlottesville and the County of Albemarle, as Licensors, and Qwest <br />Communications Corporation, as Licensee, for the installation and <br />maintenance of an underground fiber optic cable at an agreed upon location <br />in Darden Towe Park for a period of five years. <br /> <br />Underground Right-of-Way License Agreement between the City of <br />Charlottesville, as Licensor, and Qwest Communications Corporation, as <br />Licensee, for the installation and maintenance of an underground fiber <br />Optic cable at an agreed upon location in the Meadow Creek golf course <br />for a period of five years. <br /> <br />ORDINANCE: <br /> AMENDING ZONING ORDINANCE RE: PODS <br /> <br /> Mr. Schilling asked if the ordinance will be retroactive to existing portable <br />storage containers (PODS) and if they will be subject to the 30 day rule. <br /> <br /> Mr. Brown said they will be subject to the rule if they are in lawful use now. <br /> <br /> Mr. Schilling said some PODS in the City have been there a long time and are <br />annoying to people. He asked if the ordinance is passed will they be subject to the 30 day <br />limit. <br /> <br /> Mr. Brown said staff will talk and see what authorize we have over existing <br />PODS. <br /> <br /> Mr. Schilling asked if it is legal to limit the size of the lettering on PODS so it is <br />less conspicuous as advertising. <br /> <br /> Mr. Tolbert said that staff proposed limiting the size, but the Planning <br />Commission did not recommend it. He said he need to see how the public hearing was <br />advertised and if it was included in the advertisement then the ordinance could be <br />amended on second reading. <br /> <br /> Mr. Caravati agreed about the lettering. He said the PODS are more like signs <br />than storage containers. <br /> <br /> <br />
