2
Dr. Brown said the Resolution Authorizing a Settlement of the 800 MHZ Contract
Dispute has been added to the consent agenda.

Mr. Craig Brown, City Attorney, explained that the City, U. Va. and Albemarle
County contracted to purchase a public safety radio system. He said money was retained
due to delays. He said a proposed agreement has been reached that allows the
Emergency Communications Center to retain $400,000, and Motorola will provide three
categories of equipment. He said the agreement has been endorsed by Albemarle
County, U. Va. and the ECC Management Board.

Mr. Lynch said he has concerns about the Resolution Supporting the SAFTEA
Grant for the Lewis & Clark Exploratory Center, but because the application is due on
nd
December 22, it was agreed that it would be discussed at this meeting.

Mr. Lynch said he has asked for information on City grant requests. He said his
concern is that there is the potential for the Lewis and Clark project to go beyond a single
year project, and he wants to make sure if we support their application it is clear that it is
a one year deal. He said he is also concerned that this is the only project for the City, and
is disappointed that there is no other City project.

Mr. Norris said he shares the concern and asked for information on competing
projects.

Mr. O’Connell said the City has no projects.

Mr. Lynch said we need to be explicit that our support is a one time deal.

Dr. Brown said he is comfortable with that, and if there is another application next
year, Council will have the opportunity to oppose or support it.

Ms. Hamilton said there is nothing in the proposed resolution to prevent Council
from doing that.
Mr. Taliaferro agreed.

On motion by Mr. Lynch, seconded by Ms. Hamilton, the following consent
agenda items were approved by the following vote. Ayes: Dr. Brown, Ms. Hamilton,
Mr. Lynch, Mr. Norris, Mr. Taliaferro. Noes: None.

a.
