<br /> <br />5 <br />BE IT FURTHER RESOLVED <br /> by the Council that the following matters, to the <br />extent applicable, are not waived: <br /> <br />1. Peddler's license fee imposed by City Code §14-17(d) ($125 annual fee). <br />2. Policing deposit for carnival imposed by City Code §3-2 ($50/day). <br />3. Vendor regulations in accordance with City Code §28-111, et seq., <br />provided, however, that vendors shall be allowed to operate until 11:00 <br />p.m. for the duration of the festival. <br />4. Liability insurance in the amount of at least $1,000,000 with certificate of <br />insurance naming City as an additional insured. <br />5. Permit for fireworks display approved by Fire Department. <br />6. Inspection of amusement rides. <br /> <br />BE IT FURTHER RESOLVED <br />that the Dogwood Festival Board shall be responsible <br />for: <br /> <br />(a) Providing five (5) portajohns at McIntire Park during the festival, one of which shall <br />be handicapped accessible. <br />(b) Payment for additional dumpsters (and collection of refuse from the dumpsters) at the <br />carnival site. <br />(c) Cost of electricity, which shall be billed to the Dogwood Festival Board. <br />(d) Repair costs, if any, to the grounds at McIntire Park. The Dogwood Festival Board <br />will comply with the mutually agreed upon process (copy attached) intended to limit <br />damage to the park grounds. <br /> <br />RESOLUTION <br />i. : Authorizing Application for State Transit Grant <br /> <br />BE IT RESOLVED <br /> by the Charlottesville City Council that the Transit Manager <br /> <br />is authorized, for and on behalf of the City of Charlottesville, hereafter referred to as the, <br />PUBLIC BODY <br />, to execute and file an application to the Department of Rail and Public <br /> <br />Transportation, Commonwealth of Virginia, hereafter referred to as the, <br />DEPARTMENT <br />, for a grant of financial assistance in the amount of $7,895,765 to <br /> PUBLIC BODY <br />defray the costs borne by the for public transportation purposes and to <br />DEPARTMENT <br />accept from the grants in such amounts as may be awarded, and to <br />DEPARTMENT <br />authorize the Transit Manager to furnish to the such documents and <br />other information as may be required for processing the grant request. <br /> <br />The Charlottesville City Council certifies that the funds shall be used in <br />accordance with the requirements of Section 58.1-638.A.4 of the Code of Virginia, that <br /> PUBLIC BODY <br />the will provide funds in the amount of $3,213,312, which will be used <br />to match the state funds in the ratio as required in such Act, that the records of receipts of <br />PUBLIC BODY <br />expenditures of funds granted the may be subject to audit by the <br />DEPARTMENT <br /> and by the State Auditor of Public Accounts, and that funds granted to <br />PUBLIC BODY PUBLIC BODY <br />the for defraying the expenses of theshall be used <br />only for such purposes as authorized in the Code of Virginia. The undersigned duly <br />PUBLIC BODY <br />qualified and acting Clerk of Council of the certifies that the foregoing <br />is a true and correct copy of a Resolution, adopted at a legally convened meeting of the <br />Charlottesville City Council held on the 20th day of February, 2007. <br /> <br />RESOLUTION <br />j. : Incorporating Code Renumbering for Community Criminal <br /> Justice Board <br /> <br />Whereas <br />, the Virginia General Assembly has adopted legislation entitled the <br />Comprehensive Community Corrections Act for Local-Responsible Offenders, Article 9 <br />(§ 9.1-173 et seq.) of the Code of Virginia and the Pretrial Services Act, Article 5 (§ <br />19.2-152.2 et seq.) of the Code of Virginia, both of which were effective July 1, 1995; <br />and <br /> <br />Whereas <br />, §§ 9.1-174 and 19.2-152.2 of the Code of Virginia require Albemarle <br />and Nelson Counties and the City of Charlottesville that pursuant to § 53.1-82.1 were <br />approved for a jail project to participate and establish services and in accordance with <br />both Acts; and <br /> <br /> <br />
