5 BE IT FURTHER RESOLVED by the Council that the following matters, to the extent applicable, are not waived: 1. Peddler's license fee imposed by City Code §14-17(d) ($125 annual fee). 2. Policing deposit for carnival imposed by City Code §3-2 ($50/day). 3. Vendor regulations in accordance with City Code §28-111, et seq., provided, however, that vendors shall be allowed to operate until 11:00 p.m. for the duration of the festival. 4. Liability insurance in the amount of at least $1,000,000 with certificate of insurance naming City as an additional insured. 5. Permit for fireworks display approved by Fire Department. 6. Inspection of amusement rides. BE IT FURTHER RESOLVED that the Dogwood Festival Board shall be responsible for: (a) Providing five (5) portajohns at McIntire Park during the festival, one of which shall be handicapped accessible. (b) Payment for additional dumpsters (and collection of refuse from the dumpsters) at the carnival site. (c) Cost of electricity, which shall be billed to the Dogwood Festival Board. (d) Repair costs, if any, to the grounds at McIntire Park. The Dogwood Festival Board will comply with the mutually agreed upon process (copy attached) intended to limit damage to the park grounds. RESOLUTION i. : Authorizing Application for State Transit Grant BE IT RESOLVED by the Charlottesville City Council that the Transit Manager is authorized, for and on behalf of the City of Charlottesville, hereafter referred to as the, PUBLIC BODY , to execute and file an application to the Department of Rail and Public Transportation, Commonwealth of Virginia, hereafter referred to as the, DEPARTMENT , for a grant of financial assistance in the amount of $7,895,765 to PUBLIC BODY defray the costs borne by the for public transportation purposes and to DEPARTMENT accept from the grants in such amounts as may be awarded, and to DEPARTMENT authorize the Transit Manager to furnish to the such documents and other information as may be required for processing the grant request. RESOLUTION j. : Incorporating Code Renumbering for Community Criminal Justice Board Whereas , the Virginia General Assembly has adopted legislation entitled the Comprehensive Community Corrections Act for Local-Responsible Offenders, Article 9 (§ 9.1-173 et seq.) of the Code of Virginia and the Pretrial Services Act, Article 5 (§ 19.2-152.2 et seq.) of the Code of Virginia, both of which were effective July 1, 1995; and Whereas , §§ 9.1-174 and 19.2-152.2 of the Code of Virginia require Albemarle and Nelson Counties and the City of Charlottesville that pursuant to § 53.1-82.1 were approved for a jail project to participate and establish services and in accordance with both Acts; and
