10
Mr. Norris agreed with Dr. Brown and said we need to follow up on how to
engage with the long time residents and find out what kind of financial benefits there
would be for the entire neighborhood.

Mr. Tolbert suggested moving the public meeting to Buford School which would
keep it in the neighborhood. He suggested taking it back to Council after we get the
written report and having a meeting that would be two parts: a staff information piece
followed by a Council public hearing.

PUBLIC

Mr. Peter Kleeman, 407 Hedge Street, said it has been very difficult to get
materials for the 250 Interchange Committee meetings from staff. He recommended that
Council adopt a policy that as a project moves forward an easy mechanism should be
established to provide information to a contact list as it becomes available.

Ms. Victoria Denham, E. Market Street, said that older residents in Woolen Mills
are really excited about the prospect of being designated an historic district. She said it is
really important for the neighborhood to choose whether they become a local or
conservation district.

Mr. Bill Emory, E. Market Street, said that neighborhood interest in an historic
district is important, and his neighborhood is eager for such designation. He said the
Woolen Mills has a story to tell and is vulnerable to development.

Ms. Carla Manno, 324 7 ½ Street, said she appreciates that City staff and Ms.
Scala are committed professionals. She said there is no cohesive plan for Fifeville. She
said R-1A zoning protects the Fife neighborhood.

OTHER BUSINESS

Mr. Norris asked staff to look into whether an e-mail with information on projects
can be done.

RESOLUTION
: WORKERS’ COMPENSATION SETTLEMENT

Mr. Brown said that a City employee was injured and was offered a proposed
settlement of $50,000. He said the employee brought suit against a third party. He said
the resolution would approve the $50,000 settlement, contingent on the City’s receipt of
$32,800.26 from the third party.

On motion by Mr. Norris, seconded by Mr. Lynch, the Resolution Approving a
Settlement of a Workers’ Compensation Subrogation Claim was approved by the
following vote. Ayes: Dr. Brown, Mr. Lynch, Mr. Norris, Mr. Taliaferro. Noes: None.
Absent: Ms. Hamilton.

WHEREAS
, the City has made payments to a current employee pursuant to the
Virginia Workers’ Compensation Act for injuries sustained in the course of his
employment; and

WHEREAS
, the employee (whose name is not stated herein for privacy reasons)
has brought suit against the third party who caused his work-related injuries, and has
been offered a proposed settlement of $50,000, which is the limit of the third party’s
insurance coverage; and

WHEREAS
, pursuant to its statutory right of subrogation the City is entitled to
$32,800.26 of the settlement proceeds.

NOW, THEREFORE, BE IT RESOLVED
by the Council of the City of
Charlottesville, Virginia, that it appearing to be in the best interests of the City, the third
party settlement for $50,000 referenced herein is approved, contingent on the City’s
