11 <br /> Mr. Lynch said this building raises the bar for what is on Jefferson Park Avenue, <br />but he said the question is if a steep slope is the place for high density housing. <br /> <br /> Mr. Norris said he appreciates the efforts by the applicants to address Council’s <br />concerns. He said the ideal would be an even smaller building, but he realizes that in <br />order to get the amenities a certain economy of scale is needed. He said he is willing to <br />support the special permit, and he made a motion to approve the revised special permit <br />application. <br /> <br /> Ms. Hamilton seconded the motion, and the Resolution Approving the Special <br />Permit for 1707 Jefferson Park Avenue was approved by the following vote. Ayes: Dr. <br />Brown, Ms. Hamilton, Mr. Norris, Mr. Taliaferro. Noes: Mr. Lynch. <br /> <br />WHEREAS <br />, Trackside Properties, LLC (“Applicant”) has requested a special use <br />permit with respect to property identified on City Tax Map 16 as Parcel 9 (1707 Jefferson <br />Park Avenue), consisting of approximately 0.261 acres (“Subject Property”), to allow: <br /> <br />(1) Increased density to 46 38 units per acre; <br />(2) Increased building height to 50 feet at the street level and 58’-6” at the top level; <br />(3) Reduction in the front yard setback on Jefferson Park Avenue to 12’ and to 10’ on <br />Montebello Circle, and in the side yard setbacks to 10’; and <br />(4) Waiver of off-street parking requirements to allow a handicapped parking space <br />on Montebello Circle. <br /> <br />WHEREAS <br />, the subject parcel is zoned “R-3” (Residential) with overlay zoning <br />in the Entrance Corridor Overlay District, where, pursuant to §§34-162, 34-353(b)(3), <br />and 34-420 of the City Code, such modifications for use of the property are allowed by <br />Special Use Permit; and <br /> <br />WHEREAS <br /> , a joint public hearing on this application was held before the City <br />Council and Planning Commission on April 10, 2007, following notice to the public and <br />to adjacent property owners as required by law; and <br /> <br />WHEREAS <br />, on April 10, 2007, based on the information presented by <br />Neighborhood Development Services staff as well as by the Applicant, the Planning <br />Commission recommended that the application be approved, with conditions; and <br /> <br />WHEREAS <br />, this City Council finds and determines that granting the Special Use <br />Permit would be consistent with City Code §§34-162 (setbacks and parking), 34- <br />353(b)(3) (building height), and 34-420 (density) and the criteria generally applicable to <br />special use permits under Chapter 34 of the City Code; now, therefore, <br /> <br />BE IT RESOLVED <br /> by the Charlottesville City Council that a special use permit <br />is hereby granted for increased residential density of 46 38 units per acre, with increased <br />building height of 50 feet at the street wall and 58 feet, 6 inches at the top level, subject <br />to the following conditions, exceptions and modifications: <br /> <br />a. Preliminary Site Plan approval by the Planning Commission. <br />b. Administrative approval of the final site plan. <br />c. Final approval of a certificate of appropriateness by the Entrance Corridor Review <br />Board. <br />d. The required front yard setback on Jefferson Park Avenue is reduced to 12’ and to <br />10’ on Montebello Circle, and the side yard setbacks are reduced to 10 feet. <br />e. The off street parking requirement in Section 34-972(c) is waived to allow for a <br />driveway, accessible parking space and access to that space to encroach in the front yard <br />of Montebello Circle. <br />f. Implementation of arborist recommended measures to ensure the future health of <br />the trees, to be implemented prior to construction, and a tree conservation checklist to <br />ensure that the trees to be preserved will be protected during construction. <br /> <br />REPORT <br />: ONE WAY TRAFFIC ON FRANKLIN STREET <br /> <br /> <br />
