10 <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, BY <br />THE RE-ZONING OF PROPERTY LOCATED AT 1701 RIALTO STREET (CITY <br />TAX MAP 59, PARCELS 375, 375.1 AND 379) FROM R-1S (RESIDENTIAL)TO <br />PLANNED UNIT DEVELOPMENT” was offered and carried over to the next meeting <br />for consideration. <br /> <br />PUBLIC HEARING/ORDINANCE <br />: CLOSING A PORTION OF RIGHT OF WAY <br />RD <br />DESIGNATED AS 3 STREET OFF DOUGLAS AVENUE <br /> <br /> Ms. Creasy said that this street closing is before Council because there was <br />concern by some neighbors about access to their property. She said utilities are located <br />and an easement will need to be provided. <br /> <br /> Responding to a question from Ms. Hamilton, Ms. Creasy said that two people <br />objected originally, but she has been told that one has withdrawn their objection though <br />she has no official documentation of that. <br /> <br /> Mr. Peter Wiley, 217 Douglas Avenue, petitioner for the street closing, said that <br />both parties who objected have withdrawn and planned to speak, but had to leave the <br />meeting. He said one asked that they continue to have access to their property on <br />Goodman through the other alley. <br /> <br /> Dr. Brown said he would like to hear directly from those previously opposed prior <br />to the second reading of the ordinance. <br /> <br /> The public hearing was opened. <br /> <br /> Ms. Pam Scott, 215 Douglas Avenue, said the only reason the alley is accessible <br />is because certain property owners have maintained it. She said there have been <br />problems in the alley and the police will not enforce it. <br /> <br /> Mr. Eugene Schettini, 214 Douglas Avenue, supported the street closing. <br /> <br /> Mr. Leo Arico, 222 Douglas Avenue, said he does not see why these streets have <br />remained paper streets for so long. <br /> Mr. Craig Graighurst, 710 Blenheim Avenue, said he is a tour guide, and said that <br />alleys in general are great assets for pedestrians and biking. <br /> <br /> Mr. Wiley said that it is clear that ownership of the alley is by the adjoining <br />property owner. <br /> <br /> Dr. Brown said he has looked at the alley and it is obvious that the property <br />owners have put a lot of effort in their yards and the alley. He said the alley remains <br />paralleling Goodman and Douglas. He said if there is no concern by other property <br />owners he is happy to move forward, but would like to hear from those who originally <br />objected before the second reading. <br /> <br /> Mr. Lynch said he is not sure why this street closing even had to come to Council, <br />and made a motion to approve the street closing. <br /> <br /> Ms. Hamilton seconded the motion, and the ordinance entitled “AN <br />ORDINANCE CLOSING, VACATING, AND DISCONTINUING THAT PORTION <br />OF AN UNACCEPTED RIGHT OF WAY (3rd STREET) LOCATED OFF DOUGLAS <br />AVENUE ADJACENT TO PARCELS 343 AND 344 ON CITY TAX MAP 58” was <br />offered and carried over to the next meeting for consideration. <br /> <br /> Ms. Hamilton said that those who had objections can either write or phone in their <br />comments. <br /> <br />PUBLIC HEARING/ORDINANCE <br />: EXCHANGE OF WATER STREET GARAGE <br />PARKING SPACE UNITS WITH CPC <br /> <br /> <br />
