8 <br />between Sunset Avenue and Fontaine Research Park/29-250 Bypass that would divert <br />traffic from Old Lynchburg Road; and commit to continued development of alignment <br />and funding scenarios for the Eastern Connector. <br /> <br /> Ms. Hamilton noted that the agreement is with VDOT, not Albemarle County. <br /> <br /> Mr. Lynch said we are going to want to see a functioning interchange, and should <br />also ask for movement on the southern parkway. <br /> <br /> Dr. Brown said that Mr. Norris’ proposals are not conditions that will be fulfilled <br />in the near future, but said we can say those are our expectations. <br /> <br /> Mr. Norris suggested adding that there be no at grade intersection. <br /> <br /> Mr. Brown noted that VDOT has to agree to all of the conditions in the <br />agreement. <br /> <br /> Mr. Taliaferro made a motion to approve the Resolution Granting the Temporary <br />Construction Easement to VDOT for McIntire Road Extended on that condition that 49.1 <br />acres of replacement parkland be acquired, that the stormwater plan be approved, and that <br />there be no at grade intersection. <br /> <br /> Ms. Hamilton seconded the motion. <br /> <br /> Mr. Lynch made a friendly amendment to add Mr. Norris’ expectations of <br />Albemarle County. <br /> <br /> Ms. Hamilton suggested language saying “ask VDOT to use any means at their <br />disposal to ensure the County lives up to their agreement to” before Mr. Norris’ <br />proposals. <br /> <br /> Mr. Lynch suggested adding that we look to VDOT to start providing funds on <br />the conditions. <br /> <br /> Dr. Brown suggested adding a paragraph saying “be it further enacted with the <br />expectation that,” then Mr. Norris’ and Mr. Lynch’s language. <br /> <br /> Mr. Brown said that those proposals can be put in the resolution, but they are not <br />really enforceable and would not be considered conditions in granting the easement. <br /> <br /> Mr. Norris said that would be fine. <br /> <br /> Mr. Brown suggested the language be modified to say title or permanent easement <br />over 49.1 acres of replacement parkland, review and approval by Council of the <br />stormwater plan, and written confirmation from VDOT that there will not be an at grade <br />intersection. <br /> <br /> Dr. Brown said that VDOT should endeavor to make sure the proposals listed by <br />Mr. Norris are fully funded when designed. <br /> <br /> Mr. Taliaferro accepted Mr. Lynch’s amendment. <br /> <br /> The Resolution Granting the Construction Easement to VDOT for McIntire Road <br />Extended, as amended, was approved by the following vote.
