RESOLUTION <br />: Authorizing Grant Application from Land & Water <br />Conservation Fund <br /> <br /> <br />WHEREAS, <br /> the Virginia Department of Conservation and Recreation (DCR) <br />provides funds to political subdivisions of the Commonwealth of Virginia in acquiring <br />and developing open space and park lands; and <br /> <br />WHEREAS, <br /> there are urgent needs within the City of Charlottesville to develop <br />park land; and <br /> <br />WHEREAS, <br /> Riverview Park is deemed of high development priority by the City <br />and staff have proposed improvements to Riverview Park, to include a boat launch, pier <br />and pedestrian access to the river, also referred to as the Rivanna River Overlook and <br />Public Access Project; and <br /> <br />WHEREAS, <br /> in order to attain funding assistance from DCR it is necessary that <br />the City of Charlottesville guarantee that a proportionate share of the cost of said project <br />is available; and <br /> <br />WHEREAS, <br /> the City’s proportionate project share (estimated at $10,000) shall <br />be funded through an in-kind match of volunteer hours and equipment; <br /> <br />Now, Therefore, Be It Resolved <br /> by the Council for the City of Charlottesville <br />that the City of Charlottesville supports application to the Virginia Department of <br />Conservation and Recreation for LWCF funding to make access improvements to the <br />Rivanna River at Riverview Park. <br /> <br />And Be It Further Resolved <br /> that: <br /> <br />1. Such information or materials as may be necessary shall be provided to the <br />Department of Conservation and Recreation and the City Manager, or his designee, may <br />enter into such agreements as may be necessary to permit the formulation, approval and <br />funding of the Rivanna River Overlook and Public Access Project . <br /> <br />2. The City hereby assures that the General Provisions of the Land and Water <br />Conservation Fund Act and the fiscal procedures will be complied with in the <br />administration of this project. <br /> <br />3. The City will operate and maintain the public recreation facility in good <br />condition and will provide permanent signage acknowledging the contributions of the <br />participating funding agencies and that this signage will clearly state that the said facility <br />is a public recreational facility. <br /> <br />4. The City shall dedicate the metes and bounds of the Rivanna River Overlook and <br />Public Access Project properties in perpetuity, for public outdoor recreational purposes in <br />accordance with the Land and Water Conservation Fund Act. <br /> <br />5. The City hereby assures that all applicable federal and state regulations governing <br />such expenditure of funds will be complied with in the administration, development, and <br />subsequent operation of this project. <br /> <br />And Be It Further Resolved <br /> that the Department of Conservation and Recreation is <br />respectfully requested to approve the City’s application for LWCF funds for the Rivanna <br />River Overlook and Public Access Project in order to enhance the standard of public <br />recreational enjoyment for all our citizenry. <br /> <br /> <br /> <br /> <br />
