Main <br /> Street <br /> <br />WHEREAS <br /> , Studio House, LLC, owner of the property at 1003 West Main <br />Street (City Tax Map 10, Parcel 51), has requested a special use permit to allow an <br />additional ten (10) feet of building height to a maximum height of seventy (70) feet, and <br />to allow the building’s balconies to encroach into the side setback along 10½ Street, on <br />said property; and <br /> <br />WHEREAS <br /> , following a joint public hearing before this Council and the <br />Planning Commission, duly advertised and held on August 12, 2008, this Council finds <br />that such use is allowed under City Code Section 34-420, and will conform to the criteria <br />applicable to special permits generally under Chapter 34 of the City Code; now, therefore <br /> <br />BE IT RESOLVED <br /> by the Council of the City of Charlottesville, Virginia that a <br />special use permit is hereby approved and granted to Studio House, LLC to allow an <br />additional ten (10) feet of building height to a maximum height of seventy (70) feet, and <br />to allow the building’s balconies to encroach up to five (5) feet into the side setback <br />along 10½ Street, for the development at 1003 West Main Street. This special use permit <br />is conditioned upon: <br /> <br />1. Two (2) of the housing units must be offered as affordable housing to persons <br />earning 60% of the Area Median Income; and <br />2. Shade trees must be planted on West Main Street; and <br />3.
