3 <br />Map 11), has requested a special use permit to increase the density of such property from <br />21 units per acre to 32 units per acre in order to construct a 27 room Bed and Breakfast <br />establishment, retain 5 existing apartments, and build a new 36 unit apartment complex, <br />from two existing residential buildings; <br /> <br />WHEREAS <br />, following a joint public hearing before this Council and the <br />Planning Commission, duly advertised and held on December 9, 2008, this Council finds <br />that such use is allowed under City Code Section 34-420, and will conform to the criteria <br />applicable to special permits generally under Chapter 34 of the City Code; now, therefore <br /> <br />BE IT RESOLVED <br /> by the Council of the City of Charlottesville, Virginia that a <br />special use permit is hereby approved and granted to Tenth & Main LLC to allow <br />increased density from 21 units per acre to 32 units per acre of property at 100, 102, and <br />104 Oakhurst Circle and 1616 Jefferson Park Avenue (designated as Parcels 1-4 on City <br />Tax Map 11). This special use permit is conditioned upon: <br /> <br /> <br />1.Provision of at least four (4) bicycles for use by the residents or guests of the bed <br />and breakfast establishment; and <br /> <br />2.Realignment of the Jefferson Park Avenue/Emmet Street intersection; and <br /> <br />3.Acquisition by Tenth & Main LLC from the City of approximately 0.13 acres of <br />land currently in the City of Charlottesville right of way as a result of the <br />realignment of Jefferson Park Avenue and Emmet Street in a manner <br />substantially in conformance with the Applicant’s conceptual plan considered at <br />the Joint Public Hearing on December 9, 2008; and <br /> <br />4.Reduction of the front yard setback to twelve (12) feet as represented on the <br />conceptual site plan considered at the Joint Public Hearing on December 9, 2008; <br />and <br /> <br />5.Achievement of at least 10 points on the City’s LID worksheet; and <br /> <br />6.Development shall include 36 new apartments (33 two-bedroom units and 3 one- <br />bedroom units) and the continued use of 104 Oakhurst Circle as 5 one-bedroom <br />apartments. <br /> <br />PUBLIC HEARING./ORDINANCE <br />: CONVEYANCE OF VISITORS CENTER ON <br />ROUTE 20 SOUTH TO COMMONWEALTH OF VIRGINIA <br /> <br /> Mr. Brown explained that the ordinance will convey the City’s interest in the <br />property that was formerly the Visitor’s Center to the State Board of Community <br />Colleges for PVCC to use as a workforce development center. He said the property was <br />jointly acquired by the City and Albemarle County in 1984, but there are restrictions on <br />the use of the property in the deed and if not used it is to be conveyed back to the State. <br /> <br /> Mr. Taliaferro said he and Ms. Edwards would like to meet with Dr. Friedman to <br />get more information on what will be done at the workforce development center. <br /> <br /> The public hearing was opened. <br /> <br /> Ms. Colette Hall, 101 Robertson Lane, said she hopes Council moves forward <br />with the proposal and that PVCC has the opportunity to use the property. <br /> <br /> Mr. Peter Kleeman, 407 Hedge Street, said he serves on the PVCC Board, and is <br />personally impressed with the plans for the facility. He said he thinks it will be a benefit <br />to City residents. <br /> <br /> As there were no further speakers, the public hearing was closed. <br /> <br /> On motion by Dr. Brown, seconded by Ms. Edwards, the ordinance entitled “AN <br />ORDINANCE AUTHORIZING THE CONVEYANCE OF LAND ON ROUTE 20 <br />SOUTH, KNOWN AS THE VISITOR’S CENTER, TO THE COMMONWEALTH OF <br />VIRGINIA FOR USE BY PIEDMONT VIRGINIA COMMUNITY COLLEGE” was <br />offered and carried over to the next meeting for consideration. <br /> <br /> <br /> <br />
