4 <br />WHEREAS, <br /> this Council finds and determines that the public necessity, <br />convenience, general welfare and good zoning practice require the study of certain <br />amendments to Chapter 34 (Zoning) of the Charlottesville City Code, 1990, as amended. <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> by the City Council of the City of <br />Charlottesville that the Planning Commission is hereby directed to initiate a study of <br />proposed amendments to Chapter 34 (Zoning) of the Charlottesville City Code, 1990, as <br />amended, to eliminate the parking exempt zones; enact requirements for on-site parking, <br />off-site parking, and payment into a fund to build a new public parking garage and/or to <br />create a park & ride system; and to include incentives for developers to encourage <br />carpooling, car shuttling, biking, or use of mass transit; <br /> <br />BE IT FURTHER RESOLVED <br /> that the Planning Commission will submit its <br />findings and recommendations to the City Council no later than May 28, 2009. <br /> <br />RESOLUTION <br />g. : Approving Settlement of Litigation re: Juvenile & <br /> Domestic Relations Court Renovation Project <br /> <br />WHEREAS <br />, the City of Charlottesville is a party in a lawsuit currently pending <br />in Charlottesville Circuit Court, which lawsuit was initiated as a result of the collapse of a <br />portion of an exterior wall of the Juvenile and Domestic Relations District Court <br />building; and, <br /> <br />WHEREAS <br /> , all parties involved in the lawsuit have, through mediation, reached <br />a tentative settlement of all claims arising from the wall collapse; and, <br /> <br />WHEREAS, <br /> the terms of the settlement are set forth in a draft settlement <br />agreement attached hereto; and, <br /> <br />WHEREAS, <br /> in order to avoid the uncertainties and additional costs of further <br />litigation it is in the City’s best interest to approve the settlement. <br /> <br />NOW, THEREFORE, BE IT RESOLVED <br /> by the Council for the City of <br />Charlottesville, Virginia that the proposed settlement of the above-described lawsuit, as <br />described in the attached document entitled “Settlement Agreement and Releases” is <br />hereby approved, and the City Attorney is authorized to execute the Agreement and any <br />other documents necessary to effectuate the settlement on behalf of the City, subject to <br />execution by all other parties to the Agreement and approval of the final wording of the <br /> <br />Agreement by legal counsel for the City. <br /> <br />RESOLUTION <br />h. : Authorizing $250 from Council Reserve for Preservation <br /> Piedmont Historic Preservation Week Activities <br /> <br /> BE IT RESOLVED <br />by the City Council of the City of Charlottesville, Virginia <br />that the sum of $250 is hereby paid from currently appropriated funds in the Council <br />Reserve account in the General Fund to Preservation Piedmont: <br /> <br />$250 Fund: 105 Cost Center: 10110010000 <br /> <br />ORDINANCE <br />i. : “AN ORDINANCE AMENDING AND REORDAINING <br /> ARTICLE I (ADMINISTRATION) OF CHAPTER 34 (ZONING) OF THE CODE <br /> OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, RELATED TO <br /> REQUIREMENTS TO PROVIDE AFFORDABLE DWELLING UNITS” <br /> (carried over) <br /> <br />ORDINANCE <br />j. : “AN ORDINANCE AMENDING ARTICLE II <br /> (OVERLAY DISTRICTS) OF CHAPTER 34 (ZONING) BY ADDING A NEW <br /> DIVISION, TO BE NUMBERED DIVISION 5, ENTITLED “HISTORIC <br /> CONSERVATION OVERLAY DISTRICTS,” AND AMENDING ARTICLE X <br /> (DEFINITIONS), OF THE CHARLOTTESVILLE CITY CODE, 1990, AS <br /> AMENDED, RELATING TO HISTORIC CONSERVATION DISTRICTS” <br /> (carried over) <br /> <br />
