9 <br /> <br />Lease Agreement dated March 16, 2009, between the City of <br />Charlottesville and the Albemarle County Historical Society, Inc., <br />d/b/a the Albemarle Charlottesville Historical Society, for the lease <br />of the building at 200 Second Street, N.E., Charlottesville, <br />Virginia. Such agreement shall be for an initial period from March <br />16, 2009 to June 30, 2010, with two automatic renewal terms, each <br />for a period of one year, unless either the City or the Historical <br />Society notifies the other in writing of its decision not to renew the <br />lease 180 days prior to expiration of the then current lease term. <br /> <br />PUBLIC HEARING/RESOLUTION <br />: AMENDING RIVANNA WATER AND <br />SEWER AUTHORITY AGREEMENT TO ADD ELECTED OFFICIALS AS <br />MEMBERS <br /> <br /> Mr. Craig Brown, City Attorney, said that separate public hearings are required <br />for the proposed change in composition to the Rivanna Water and Sewer Authority and <br />Rivanna Solid Waste Authority. He said the proposal is to add a member of City Council <br />and Albemarle County Board of Supervisors. He said the Board of Supervisors will take <br />up the proposal on April 1. <br /> <br /> The public hearing was opened. <br /> <br /> Mr. Kevin Lynch, 609 Locust Avenue, said he is glad to see Council taking the <br />governance of RWSA seriously. He suggested that before changes are made that Council <br />read the State Code as the Authority is improperly constituted now, and has a four-year <br />limit to terms. He said it does not account for people there because of their positions, and <br />that should be rectified. He said part of the problem with Rivanna is people are stretched <br />too thin. He said that does not change much to add a Councilor and a Board member. He <br />said someone should be added that has sole responsibility for water. <br /> <br /> Ms. Betty Mooney, 201 Sunset Avenue, said she thinks this action is premature <br />and people did not know about it. She said the current board is illegally constituted. She <br />said there is no oversight on the board. She said community discussions should be <br />organized about the proposal. <br /> <br /> As there were no further speakers, the public hearing was closed. <br /> <br /> Mr. Norris said the proposal has been in the public domain for months. He asked <br />Mr. Brown to comment on the charge that the board is illegally constituted. <br /> <br /> Mr. Brown said the RWSA has had its current composition for the past 37 years. <br />He said the resolution before Council addresses the four-year term issue. <br /> <br /> Dr. Brown agreed that there has been a lot of discussion on the proposal. <br /> <br /> Dr. Brown moved the resolution and it was seconded by Mr. Huja. <br /> <br /> Mr. Norris said the reason for the proposal is because of concerns about <br />governance. He said he thinks it is a good step forward. <br /> <br /> The Resolution Amending the Rivanna Water and Sewer Authority Agreement to <br />Add Elected Officials was approved by the following vote. Ayes: Dr. Brown, Ms. <br />Edwards, Mr. Huja, Mr. Norris, Mr. Taliaferro.
