<br />WHEREAS
<br />, Virginia Delta Upsilon Alumni Association, Inc., owner of property
<br />at 135 Madison Lane, has requested a special use permit with respect to the property
<br />identified on City Tax Map 9 as Parcel 148, consisting of approximately 9,996 square
<br />feet of land (“Subject Property”), to allow construction and operation of a fraternity
<br />house; and
<br />
<br /> WHEREAS
<br />, the Subject Property is zoned R-3 Multifamily Residential District,
<br />and, pursuant to §34-420 of the City Code, such modifications for use of the property are
<br />allowed by Special Use Permit; and
<br />
<br />WHEREAS
<br />, following a joint public hearing before this Council and the
<br />Planning Commission, duly advertised and held on May 12, 2009, this Council finds that
<br />such use is allowed under City Code Section 34-420, and will conform to the criteria
<br />applicable to special permits generally under Chapter 34 of the City Code; now, therefore
<br />
<br />BE IT RESOLVED
<br /> by the Council of the City of Charlottesville, Virginia that a
<br />special use permit is hereby approved and granted to Virginia Delta Upsilon Alumni
<br />Association, Inc. to allow construction and operation of a fraternity house at 135 Madison
<br />Lane. Approval of this special use permit is conditioned upon the following:
<br />

<br />1.Provision of a bike rack on the Subject Property to accommodate at
<br />least four (4) bicycles;
<br />
<br />2.Provision of an enclosure for trash receptacles, which must be
<br />completely screened from view from the street or alley by an enclosure
<br />with a minimum height of one foot (1’) taller than the trash receptacles;
<br />
<br />3.Contact information, updated annually, for a local representative of the
<br />Applicant shall be provided to the City’s property maintenance office.
<br />The local representative shall be responsible for addressing property
<br />maintenance issues and violations identified by City staff as long as the
<br />Special Use Permit is in effect.

<br /> Ms. Judy Mueller, Director of Public Works, introduced a video, produced in-
<br />house, highlighting the services of the Public Works Department. Ms. Mueller said she
<br />would like to show the video at neighborhood association meetings and elsewhere upon
<br />request.

<br />: UTILITIES RATES (2 reading)

<br /> Mr. Bernard Wray, Director of Finance, said that at Council’s request, the
<br />$60,000 in the utility budget which was to fund half of the performance manager position
<br />that was not approved, was used to further reduce rates. He said the new proposed rates
<br />are: 1.12% increase for water; 3.79% increase for waste water; and 1.39% decrease for
<br />gas.

<br /> On motion by Dr. Brown, seconded by Ms. Edwards, the ordinance was amended
<br />to reflect the new rates by the following vote. Ayes: Dr. Brown, Ms. Edwards, Mr.
<br />Norris, Mr. Taliaferro. Noes: None. Absent: Mr. Huja.

<br /> On motion by Dr. Brown, seconded by Mr. Taliaferro, the ordinance entitled “AN
<br />ORDINANCE AMENDING AND REORDAINING CHAPTER 31 (UTILITIES) OF
<br />THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED,
<br />TO ESTABLISH NEW UTILITY RATES AND SERVICE FEES FOR CITY GAS,

<br />WATER AND SANITARY SEWER,” as amended, which was offered at the May 18
<br />meeting, was approved by the following vote. Ayes: Dr. Brown, Ms. Edwards, Mr.
<br />Norris, Mr. Taliaferro. Noes: None. Absent: Mr. Huja.
