7 <br />age, marital status, disability, status as a special disabled veteran or other veteran covered <br />by the Vietnam Era Veterans Readjustment Act of 1974, as amended and sexual <br />orientation, including gender identity. <br /> <br />PUBLIC HEARING/ORDINANCE <br />: SCHENK’S BRANCH INTERCEPTOR <br />SEWER PROJECT – EASEMENT TO RWSA (THROUGH MCINTIRE PARK) <br /> <br /> Mr. Craig Brown, City Attorney, said the ordinance would grant a permanent <br />easement to Rivanna Water and Sewer Authority for a sanitary sewer connector line <br />which needs to be relocated to accommodate the construction of McIntire Road Extended <br />and to allow the line to be increased in size. <br /> <br /> Mr. Norris asked what practical impact Council opposition to the easement would <br />have on the parkway project. <br /> <br /> Mr. Brown said the line needs to be relocated for the road to be build and it could <br />not be enlarged. <br /> <br /> Mr. Norris asked about the rationale for expanding the line, and Ms. Lauren <br />Hildebrand, Public Utilities Director, said the line is now 21” and will not carry the <br />required capacity in wet weather. She said the plan is to put it at a deeper depth and get <br />rid of the aerial crossings at the stream. <br /> <br /> The public hearing was opened. <br /> <br /> Mr. Daniel Bluestone, 501 Park Hill, noted that the ordinance states that no <br />planting can be done within a certain distance of the line and the City will not be <br />reimbursed if the plants are damaged. Mr. Bluestone said RWSA is becoming a major <br />player in a public park. He said trees were to screen the Rockhill gardens and now they <br />will be gone. <br /> <br /> Mr. Stratton Salidas, said the objectives of RSWA, RWSA and the City <br />government seem to be to protect plans. He said the City falsely told the Federal <br />Highway Department that the Parkway and interchange are separate projects. He said the <br />City residents will have to pay for the expansion of the pipe. <br /> <br /> Mr. Jim Moore, 1213 Hazel Street, said he could not get good information on this <br />issue. He said the City should request more information about the impact of the <br />landscaping plan. <br /> <br /> Mr. Peter Kleeman, 407 Hedge Street, requested that Council not take action on <br />the easement or deny it as the project and design have not adequately matured. He said <br />the plans submitted by VDOT to the City and federal government are different. He said <br />the City should negotiate with VDOT on what the plan is, and said no final design has <br />been selected. <br /> <br /> Ms. Colette Hall, 101 Robertson Lane, said she sees harmful affects of VDOT’s <br />agenda. She said trees will be removed. She asked that Council deny the easement until <br />all studies are completed. <br /> <br /> As there were no further speakers, the public hearing was closed. <br /> <br /> Ms. Edwards said she would like more information about the history of the lines, <br />maintenance, and the condition that precipitated the need for expansion. <br /> <br /> Ms. Hildebrand said she thinks the line was installed in the 1950s close to the <br />creek, and it would be better to move them away from the creek. She said the lines need <br />to be increased independent of the road. <br /> <br /> Responding to a question from Mr. Taliaferro, Ms. Hildebrand said the line drains <br />from Rose Hill to the Omni. <br /> <br /> <br />
