10 <br /> <br />WHEREAS <br /> , state law allows the refunding of property taxes, with interest at the <br />same rate collected for delinquent taxes (currently 10%), for only the past three (3) years <br />worth of taxes collected; and <br /> <br />WHEREAS <br /> , the monies owed the Pride of Virginia Lodge #122 amount to <br />$5,520.46 (for the tax years 2006, 2007 and 2008); now, therefore, <br /> <br /> BE IT RESOLVED <br />by the Council of the City of Charlottesville, Virginia that <br />the City Treasurer is hereby directed to make payment in the amount of $5,520.46 to <br />Pride of Virginia Lodge #122 as reimbursement for real estate taxes erroneously assessed <br />th <br />on the property known as 305 9 Street, N.W. (City Tax Map Parcel 310228000), and <br />collected for the tax years 2006, 2007 and 2008. <br /> <br /> Mr. Norris said Council has made annual budgetary allocations in other cases and <br />he would support doing so in the budget to make up for the back taxes paid. <br /> <br /> Mr. Taliaferro said it is an issue of fairness, and Ms. Edwards agreed, apologizing <br />for the City’s mistake. <br /> <br />PUBLIC HEARING/RESOLUTION <br />: SUPPORTING BILL TO AMEND CITY <br />CHARTER RE: RESIDENCY REQUIREMENT FOR CLERK OF COUNCIL <br /> <br /> Mr. Rich Harris, Deputy City Attorney, explained that the resolution will request <br />that the General Assembly amend the City’s charter to eliminate the residency <br />requirement for the Clerk of Council. He said this requirement would limit the applicant <br />pool and would be a financial burden to someone currently living outside of the City. <br /> <br /> The public hearing was opened, but as there were no speakers, the public hearing <br />was closed. <br /> <br /> On motion by Dr. Brown, seconded by Mr. Taliaferro, the Resolution Supporting <br />the Bill to Amend the City Charter re: the Residency Requirement for the Clerk of <br />Council was approved by the following vote. Ayes: Dr. Brown, Ms. Edwards, Mr. Huja, <br />Mr. Norris, Mr. Taliaferro. Noes: None. <br /> <br />WHEREAS <br />, this Council is of the opinion that it is in the best interests of the citizens of <br />the City of Charlottesville that Section 6 of the Charter of the City of Charlottesville <br />imposing a residency requirement on the Clerk of Council be amended; and <br /> <br />WHEREAS <br />, in accordance with the requirements of §15.2-202 of the Code of <br />Virginia (1950) as amended, on December 7, 2009 this Council conducted a public <br />hearing on the proposed charter amendment, and at least ten (10) days’ notice of the time <br />and place of such public hearing, and an informative summary of the proposed charter <br />amendment was published in a newspaper of general circulation in this locality; <br /> <br />NOW, THEREFOREBE IT RESOLVED <br />, by the Charlottesville City Council <br />that the General Assembly is hereby requested to approve an amendment to Section 6 of <br />the Charter of the City of Charlottesville, to read as follows: <br /> <br />Sec. 6 Officers and clerks elected by council <br /> <br /> There may be elected by the council such officers and clerks as <br />said council deems proper and necessary, who shall serve at the pleasure <br />of council, and any one or more of said offices may be held and exercised <br />by the same person. It may be competent for the council, in order to <br />secure the services of a suitable person, to elect nonresidents, but such <br />officer, other than the Clerk of Council, shall reside in the city during his <br />tenure in office. <br /> <br />BE IT FURTHER RESOLVED <br /> that the Clerk of the City Council shall transmit <br />to the City’s legislators a certified copy of this resolution, along with (i) a copy of a <br /> <br />
