5 <br />WHEREAS <br />, following a joint public hearing before this Council and the <br />Planning Commission, duly advertised and held on March 9, 2010, this Council finds that <br />such use is allowed under City Code Section 34-480, and will conform to the criteria <br />applicable to special permits generally under Chapter 34 of the City Code; now, therefore <br /> <br />BE IT RESOLVED <br /> by the Council of the City of Charlottesville, Virginia that a <br />special use permit is hereby approved and granted to University Limited Partnership, <br />thth <br />owner of the property at 207 14 Street, to allow use of the property at 207 14 Street as <br />a 31-room hotel. This special use permit is approved with the following conditions, <br />exceptions or modifications: <br /> <br /> <br />1.A reduction in the side yard setback for the two story addition from 23 feet to 10 <br />feet on the north and 7 feet on the south. <br /> <br />2.A reduction in the required number of on-site parking spaces from 13 spaces to 3 <br />th <br />spaces, and to provide the remaining parking spaces in the 14 Street Parking <br />Garage. <br /> <br />3.The applicant shall submit a signed lease agreement verifying off-site parking to <br />Neighborhood Development Services prior to final site plan approval. <br /> <br />4.No person shall permit, operate or cause any source of sound to create a sound <br />level emanating from the building or site during the hours between 11:00 p.m. and <br />6:00 a.m. in excess of sixty -five (65) dB (A) when measured at or outside the <br />property boundary. <br /> <br />5.Administrative approval of the Preliminary Site Plan following approval of the <br />Certificate of Appropriateness by the BAR. <br /> <br />6.Twenty four (24) hour on-site management shall be provided. <br /> <br /> <br />i. ORDINANCE <br />: “AN ORDINANCE TO QUITCLAIM NATURAL <br /> GAS LINE EASEMENT LOCATED IN THE MONTGOMERY RIDGE <br /> SUBDIVISION IN ALBEMARLE COUNTY TO THE VIRGINIA <br />nd <br /> DEPARTMENT OF TRANSPORTATION” (2 reading) <br /> <br />ORDINANCE <br />j. : “AN ORDINANCE TO AMEND AND REORDAIN <br /> CHAPTER 15 (MOTOR VEHICLES AND TRAFFIC) OF THE CODE OF THE <br /> CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, BY DECREASING THE <br /> MAXIMUM SPEED LIMIT IN CERTAIN SCHOOL CROSSING ZONES” <br />nd <br /> (2 reading) <br /> <br />ORDINANCE <br />k. : “AN ORDINANCE AMENDING AND REORDAINING <br /> CHAPTER 9 (ELECTIONS), ARTICLE II, SECTION 9-29, OF THE CODE OF <br /> THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, RELOCATING THE <br /> POLLING PLACE FOR THE JEFFERSON PARK PRECINCT TO THE <br />nd <br /> MUNICIPAL ARTS BUILDING AT 1119 FIFTH STREET, S.W.” (2 reading) <br /> <br />PUBLIC HEARING <br />: CITY COUNCIL’S PROPOSED FY 11 BUDGET <br /> <br /> Ms. Leslie Beauregard, Director of Budget and Performance Management, <br />reviewed modifications to the budget including revenue adjustments and changes in the <br />following expenditures: reserve $110,000 for transit; $10,000 for PACEM, $25,000 for <br />Foothills; and $10,000 in overtime in the Police Department dedicated to Internet Crimes <br />Against Children Investigations. <br /> <br /> The public hearing was opened. <br /> <br /> Ms. Jeanne Chase, 223 Old Lynchburg Road, read a letter on behalf of Peter <br />Hedlund, President of the Fry’s Spring Neighborhood Association, noting that Old <br />Lynchburg Road still has no sidewalks or drainage, and the project must stay on track. <br />She said the first phase of design will not be completed until next January, and Council’s <br />allocation of funds will determine the next phase. She said too much time separates the <br />design and construction. She asked Council to put money back in the CIP. <br /> <br /> <br />
