28 <br /> <br /> Mr Satyendra Huja, Director of Community Development, explained that the sorority <br />proposes to add space for study and storage, but no additional students. The Planning <br />Commission recommended approval of the special perrm't for the following masons: 1) It is <br />in harmony with the Land Use Plan of the Comprehensive Plan; 2) It will not have a <br />significant adverse impact on the surrounding area if conditions are met; and 3) The use is <br />compatible with surrounding uses. <br /> <br /> Responding to a question from Ms. Daugherty, Mr. Huja said that cars parked in the <br />alley block access to other property, and requiring a fence along the property line will make <br />the alley too narrow for a car to attempt'to park. <br /> <br /> On motion by Rev. Edwards, seconded by Ms. Slaughter, the resolution approving the <br />special permit for the expansion of the sorority at 136 Madison Avenue was unanimously <br />approved by Council. <br /> <br /> WHEREAS, the ZTA Fraternity Housing Corporation, owner of the property at 136 <br />Madison Lane, has requested a special use permit to allow for an addition to the existing <br />sorority house at 136 Madison Lane. This property is further identified as Parcel 142 on City <br />Real Property Tax Map 9, having approximately 58 feet of frontage on Madison Lane, and <br />containing approximately 6,950 square feet of land or. 16 acres; <br /> <br /> WHEREAS, following a joint public hearing before this Council and the Planning <br />Commission, duly advertised and held on February 13, 1996, this Coundl finds that such use <br />wiI1 conform to the criteria applicable to special permits generally under Chapter 34 of the <br />City Code; now, therefore <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that a <br />special use permit is hereby granted to ZTA Fraternity Housing Corporation, owner of the <br />property at 136 Madison Lane, to allow for an addition to the existing sorority house at 136 <br />Madison Lane. Approval of the special use permit is conditioned upon the following: <br /> <br />(1) Administrative approval of the revised site plan with the following: <br /> <br />(a) Detail of the proposed handicapped access ramp in the rear. <br />(b) Removal of the paradise tree in the rear and its replacement with an <br /> appropriate species. <br />(c) Construction of a fence or railing along the south property line <br /> ajacent to the alley in order to prevent unauthorized parking in this <br /> alley. <br /> <br />ORDINANCE: CLOSING OF 9TH STREET, S.W. FROM WEST MAIN STREET TO <br />CSX TRACKS <br /> <br /> Mr. Huja explained that the closing of 9th Street, S.W. from West Main Street to the <br />CSX tracks, is recommended by the Planning Commission for the following reason: public <br />benefit would result in the closing in terms of construction and maintenance cost savings as <br />well as tax benefits and the reduction in liability at the railroad crossing. Approval of this <br />closing is conditioned upon the following: 1) Parcels 76, 5, 6 and 7 be combined with <br />adjoining parcels under the same ownership having frontage on West Main Street; 2) The <br />City be granted utility easements of a minimum width of 20' for all water and sewer mains <br />located in the street; and 3) The dosing tax place only after the completion of the 9th/10th <br />realignment project by VDOT. <br /> <br /> Ms. Daugherty expressed concern about pedestrian access, and Mr. Huja <br />acknowledged that pedestrian access would be moved one block away. <br /> <br /> Mr. Clyde Gouldman, City Attorney, presented Council with an amended ordinance <br />with language that would prevent any parcel from being landlocked by the dosing. <br /> <br /> <br />
