143 <br /> <br /> Mr. Kevin Lynch, 609 Locust Avenue, said that the traffic crossing the malt was a <br />stupid idea, is unsafe, and is functionally useless. Mr. Lynch suggested that it would be <br />better to two-way Market Street. Mr. Lynch said that any costs associated with the mall <br />crossing should be paid by Mr. Danielson. <br /> <br /> Ms. Daugherty said she hopes that tourists will cross the mall, and then after seeing the <br />mall, will park and visit the mall. Ms. Daugherty noted that any costs associated with the <br />mall will be shared 50/50 by the City and developer. <br /> <br />CONSENT AGENDA <br /> <br /> Ms. Richards said she will support the IDEA Grant appropriation because the grant is <br />in the final year of federal funding, but she would prefer to use drug forfeiture money for <br />chemical dependency programs. <br /> <br /> Mr. Cox said that the IDEA grant report raises a lot of questions about how the City is <br />communicating with the public about drug enforcement. Mr. Cox said the public has no way <br />of judging the program's effectiveness, and there should be more opportunity for public <br />comment. Mr. Cox said he would also like more information on personnel involved in the <br />program, including gender and race, noting that he does not feel that African-Americans are <br />well represented. <br /> <br /> Mr. Toscano noted that the IDEA program, which focuses on non-crack cocaine and <br />marijuana usage, was in direct response to concerns Council heard from the community that <br />minorities are generally targeted for drug arrests. <br /> <br /> On motion by Mr. Toscano, seconded by Ms. Daugherty, the following consent agenda <br />items were unanimously approved, with the minutes of August 5th corrected by Ms. <br />Richards: <br /> <br />a. Minutes of August 5 <br /> <br />b. APPROPRIATION: $143,740 - IDEA Grant (2nd reading) <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia, that the <br />sum of $143,740 is hereby appropriated to expenditure account 11-270-041146 to continue <br />funding for the third year an enhanced drug enforcement program. Such appropriation shall <br />be conditioned upon receipt of $107,805 from the Department of Criminal Justice Services, <br />and $35,935 from account 05-270-041110 as the City's local match, for a total appropriation <br />of $ t 43,740. <br /> <br />c. APPROPRIATION: $13,000 - Amphitheater Footings (2nd reading) <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia, that the <br />sum of $13,000.00 is hereby appropriated from account code 26-020-122050 of the Capital <br />Fund contingency to account code 26-181-091164 (Amphitheater Stage) to cover the cost of <br />bandshell footings for the amphitheater at the east end of the downtown mall. <br /> <br />d. APPROPRIATION: $4,226 - State Entitlement - Charlottesville/Albemarle <br /> Children and Youth Commission (carried over) <br /> <br />e. RESOLUTION: Approving cafe permit for Om~ Hotel <br /> <br /> WHEREAS, the Omni Charlottesville Hotel has applied to City Council for a permit to <br />operate an outdoor cafe on the pedestrian mall at 235 West Main Street in connection with <br />the operation of its duly licensed restaurant; and <br /> <br /> WHEREAS, this Council finds that the proposed outdoor cafe is in keeping with the <br />intent of the pedestrian mall, can add sigrdficantly to successful commerce in the downtown <br /> <br /> <br />
