' Mr. Toscano noted that some of the impact of consolidation is already known as a result of the first study, and feels the question is whether the County is willing to raise their level of spending in all their schools. Ms. Daugherty said she thinks the City could articulate and negotiate what is important in the schools to maintain. Mr. Cox said he feels assumptions have to be built into the study about what is important to the City. Mr. Clyde Gouldman, City Attorney, cautioned that negotiated agreements regarding school programming may not go into perpetuity, and suggested that additional legal advice be sought on this issue. On motion by Ms. Daugherty, seconded by Ms. Richards, Council unanimously voted to meeting in executive session for the purpose of consultation with legal counsel and briefings by staff members, consultants or attorneys, pertaining to probable litigation, or other specific legal matters requiring the provision of legal advice by counsel, as authorized by Section 2.1-344(A)(7) of the Virginia Code. The substance of the matters to be discussed can reasonably be identified as follows:~ changes in the form of local government structure, and related alternatives. An executive session on this subject is also authorized by Section 15.1-945.7(D) of the Virginia Code. Council reconvened in open session and, on motion by Ms. Daugherty, seconded by Ms. Richards, certified that, to the best of each member's knowledge, (i) only public business matters la~a~ully exempted from open meeting requirements by Virginia law were discussed in the executive meeting to which this certification resolution applies, and (ii) only such public business matters as were identified in the motion convening the executive meeting were heard, discussed or considered by the Council. The meeting was convened for the evening. GRAVES MOUNTAIN LODGE - September 23, 1996 Council reconvened the special session with the following members present: Mr. Cox, Ms. Daugherty, Ms. Richards, Ms. Slaughter, Mr. Toscano. Councilors discussed their Work/Action plan for the upconfing year, working from the priorites previously discussed.
