219 <br /> <br /> WHEREAS, following a joint public hearing before this Council and the Planning <br />Colranission, duly advertised and held on November 12, 1996, this Council finds that such <br />use will conform to the criteria applicable to special permits generally under Chapter 34 of <br />the City Code; now, therefore <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that a <br />special use permit is hereby granted to The Pride of Virginia Lodge #122, contract <br />purchasers of the property at 309 9th Street, N.W. to use the property as a private <br />non-cormx~ercial recreational facility for group use. This special use permit is conditioned <br />upon the following: <br /> <br />Administrative approval of the revised site plan, including the following: <br /> <br />(a) <br /> <br />Provision of at least one handicapped parking space on site <br />along with multi-use potential of the parking area. <br /> <br />(b) <br /> <br />Provision of recreational facilities on site, basketball court, <br />chess tables and horseshoe area, with super¢ision by Lodge <br />members for outdoor recreational activities. <br /> <br />Addition of screening along the boundaries of the site in the <br />form of fencing and plantings. <br /> <br />CONSENT AGENDA <br /> <br /> The Va. Recreation Trails Program appropriation and resolution authorizing $8,575 for <br />a study of two-waying Market Street were removed from the consent agenda. <br /> <br />a. Minutes of November t 1 and 18 <br /> <br />b. APPROPRIATION: $10,000 - Donation from Charlottesville Downtown <br /> Foundation for Amphitheater Landscaping (carried over) <br /> <br />c. RESOLUTION: Accepting donation of property for Ivy. Creek Natural Area <br /> <br /> WHEREAS, the City of Charlottesville and the County of Albemarle are the owners of <br />record of certain property identified as the Ivy Creek Natural Area; and <br /> <br /> WHEREAS, the property is managed by the Ivy Creek Foundation for the benefit of <br />the public for open space, passive recreation and related purposes; and <br /> <br /> WHEREAS, Martin B. Betts, D.V.M., and Anna R. Betts are the owners of record of <br />a small triangular-shaped parcel approximately .25 acres in size adjacent to the Ivy Creek <br />Natural Area; and <br /> <br /> WHEI~AS, Dr. and Mrs. Betts no longer have any need for the property, and would <br />like to donate this parcel to the City and the County to be utilized as and become part of the <br />Ivy Creek Natural Area; and <br /> <br /> WHEREAS, the County of Albemarle by resolution approved December 4, 1996, <br />accepted the donation of said property to be added to the Ivy Creek Natural Area; now, <br />therefore, <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that the City <br />Council hereby accepts the donation of the above-described property for the purposes <br />described herein and authorizes the City Manager to execute a deed, in form approved by the <br />City Attorney, and SUbstantially in the same form as attached hereto. The City Attorney is <br />hereby authorized to take whatever steps are necessa~ to effect the closing of said property <br />conveyance. <br /> <br /> <br />
