A_A_P__P_R_~,O_P_~.TIg~: $41,550.66 - Summer Nutrition Program (2nd reading) <br /> <br /> WHEREAS, the U. S. Department of Agricukure (USDA) has established the Summer <br />Food Service Program to brin~g about an increased awareness of the critical importance of <br />proper nutrition for children and a belief that school vacation should not end the availability <br />of nutritious meals for many children; and <br /> <br /> WHEREAS~ the Ciw of Charlottesville shares the same concerns as USDA; now, <br />therefore, <br /> <br /> BE iT RESOLVED by the Council of the City of Charlottesville, Virginia, that a <br />Summer Food Service Program be established as part of the City of Charlottesvitle's Summer <br />Recreation Programs and $41,550.66 is hereby appropriated from the unappropriated balance <br />of the General Fund to account code 11-042-062028 in the Grants Fund for the purpose of <br />carrying out this program. Such appropriation shall be conditioned upon substantial <br />reimbursement to the General Fund by USDA. <br /> <br />APPROPI~AATION: $3,000 - Charlottesville-Albemarle Children and Youth <br />CommissiOn (carried over) <br /> <br />d. APPROPRIATION: Consolidated Plan (CDBG Funds) FY 95/96 (carried over) <br /> <br />e. APPROPRIATION: $55,000 - Elevator for McGuffev Renovation (carried over) <br /> <br />APPROPRIATION: $3.750 - Virginia Commission of the Arts Grant (Virginia <br /> Discovew Museum and Piedmont Council for the Arts) (carried over) <br /> <br />g. RESOLUTION: Renewing cafe permit for Chaps <br /> <br /> WHEREAS, Anthonv LaBua, d/b/a Chap's Restaurant, has applied to Citv Council for <br />a permit to operate an outdoor cafe on the pedestrian mall at 223 East Main Street in <br />connection with the operation of its duly licensed restaurant (Chap's): and <br /> <br /> WHEREAS, the ori~nal permit granted by City Council on April 5, i993, to ChaD's <br />recently became null and void due to non-payment of the sidewalk cafe rent; and <br /> <br /> WHEREAS, the appropriate rent has now been paid, Chaps wishes to renew the <br />permit under the same conditions as the original permit; and <br /> <br /> WHEREAS. this Council finds that the proposed outdoor cafe is in keeping with the <br />intent of the pedestrian mall. can add significantly to successful commerce in the downtown <br />area. wilt not unreasonabiv restrict the movement of pedestrian traffic and will not endanger <br />the public heakh, safety or welfare; now, therefore, <br /> <br /> BE IT RESOLVED that Anthony LaBua, d/b/a Chap's Restaurant, is hereby ,aranted a <br />permit to operate an outdoor cafe on the pedestrian mall at 223 East Main Street, subject to <br />the following conditions and terms: <br /> <br /> 1. The permit shall be valid from its adoption until November 30, 1995, for operation <br />of the cate during the months of March through November. Not later than November 30 of <br />each year, the operator shall remove from public property ail furniture and equipment used <br />for such cafe operation. <br /> <br /> 2. The cafe shall be operated oniv in the designated area shown on the attached sketch. <br />The cafe shall be in operation only during the hours the restaurant is open. No cafe <br />furnishings or equipment shall be permitted to obstruct any fire lane. The designated area of <br />operation shall be clearly delineated by the use of a cornbination of trees, fences, planters and <br />barriers. <br /> <br /> <br />
