The p~licy shall name the City as an addkional insured as its interests <br />may appear and be in a form approved by the City Attorney. <br /> <br /> 8_ This permit may be revoked by City Council m any time after a heating conducted a~ <br />any regular meeting, ~nrovided the operator has been notified of the hearing by written notice <br />delivered to its l~!ace 0fbusiness at ieast ten days before such meeting, if the Council finds: <br />(a) thru the operator is violating the terms of the permit; (b) is delinquent, in pa_cng rem; (c) <br />that the conti'nued operation of the ca~r~ poses a threat to the public health, safeW or welfare <br />or constitutes a mfolic nuisance; or (d) if by June ist in any calendar year covered by th-is <br />per_rrfit, the outdoor cafe has not been in substantial operation for a period of 60 days, or if <br />~he cafe ceases operation for a period of 30 days or more prior to Labor Day of any year. <br /> <br /> 9. This perm-it may be revoked at an5, time upon st._ months notice to the operalor, for <br />any public purpose as determined by the City Council <br /> <br /> !0. Approval of this permit is condkioned upon the applmant ~ compliance with the <br />plans approved by the Board of Architectural Review. <br /> <br />This ._hermit shall not be assigned without the express permission of Ckv Council. <br /> <br />12. This permit shall be effective as of march i~ ! 996. <br /> <br />STAFF REPORT: PEN PARK HOUSING PROJECT <br /> <br /> Mr. Satvendra Htoa.~ Director of Communky DevelopmenL explained that a request for <br />proposals wa~s sent out in June and two responses were received. The advisory committee <br />for the project has recommended the team headed by Haiey~ Chisholm and Morris, !nc. for <br />the following reasons: !) They control the best access to the prope~y through the Coun_ty; <br />2)}They have strong financial ~capacity; 3) Their track record in construction and development <br />has been excellent.; 4) They are ~pen to a process of design and development which will allow <br />extensive pa~icipation by the City and the com_nmity to a_rri_ve at appropriate solutions for <br />the ske; and 5) ThiS group has thought a great deal about the site and Know the ske better <br />than the other team. ~Mr.'Huja note~t that the price for the prope_~.y .will need to take into <br />consideration, environ_mental factors. <br /> <br /> Ms. Slaughter asked what the next step in the process wit! be and what kinds of <br />controls the City will have over the project~ <br /> <br /> M_r~ Hula sta;~ed that City controls can be incorpora;~ed into the contract and he <br />antidpated that a contract wili be brought back to Council for their consideration in 60 to 90 <br />days~ <br /> <br /> Ms. Daughert_¥ asked if the developers have indicated a willingness to work with <br />designers William McDonough and Frank Folsom Smith, and M_r.
