257 <br /> <br /> Mr. Toscano said that he feels the undergrounding language should be dear enough to <br />avoid problems in interpretation and asked staff to study this further prior to the second <br />reading of the ordinance. <br /> <br /> On motion by Rev-. Edwards, seconded by Mr. Vandever, the ordinance entitled "AN <br />ORDINANCE GRANTING A TELECOMMLrNICATIONS FRANCHISE TO HYPERION <br />TELECOMMUNICATIONS OF VIRGINIA, INC., ITS SUCCESSORS AND ASSIGNS, <br />TO USE THE STREETS AND OTHER PUBLIC PLACES OF THE CITY OF <br />CI-L4RLOTTESVILLE, VIRGINIA, FOR ITS POLES, WIRES, CONDUITS, CABLES, <br />AND FIXTURES FOR A PERIOD OF FIVE (5) YEARS" was offered and carried over to <br />the next meeting fbr Consideration. <br /> <br />PUBLIC <br /> <br />There were no matters by the public. <br /> <br />OTHER BUSINESS <br /> <br /> Mr. Toscano encouraged people to visit the exhibit at the Virginia Discovery Museum, <br />"The Dawn of Sound." <br /> <br /> At the request of Mr. T0scano, Mr. O,Connell explained that on October 7th, a <br />contractor accidentally put chlorine in the water line in the Rose Hill area and if citizens have <br />any questions or claims, they can call the City Manager's Office or Rivanna Water and Sewer <br />Authority. Mr. O'Connell stated that to the City's knowledge, the dxlorine did not present a <br />health hazard. <br /> <br /> Mr. O'Connell announced that there are paper sorting changes at the Mclntire <br />Recycling Center. <br /> <br /> On motion by Ms. Slaughter, seconded by Rev. Edwards, Council unanimously voted <br />to meet in executive session for the purpose of appointing members to various City boards or <br />agencies, and discussion of two personnel matters, as authorized by Section 2.1-344(A)(1) of <br />the Virginia Code; for the purpose of consultation with legal counsel and briefings by staff <br />members~ consultants or attorneys, pertaining to probable litigation, or other specific legal <br />matters requiring the provision of legal advice by counsel, as authorized by Section <br />2.1-344(A)(7) of the Virginia Code; and for the purpose of consultation with legal counsel <br />and briefings by staff members, consultants or attorneys, pertaining to probable litigation, or <br />other specific legal matters requiting the provision of legal advice by counsel, as authorized <br />by Section 2.1-344(A)(7) of the Virginia Code. The substance of the matters to be discussed <br />can reasonably be identified as follows: changes in the form of local govermnent structure, <br />and related alternatives. An executive session on this subject is also authorized by Section <br />15.1-945.7(D) of the Virginia Code. <br /> <br /> Council reconvened in open session and, on motion by Ms. Slaughter, seconded by Mr. <br />Vandever, Council unanimously certified that, to the best of each member's knowledge, (i) <br />only public business matters lawfully exempted from open meeting requirements by Virginia <br />law were discussed in the executive meeting to wtfich this certification resolution applies, and <br />(ii) only such public business matters as were identified in the motion convening the executive <br />meeting~were heard, discussed or considered by the Council. <br /> <br />APPOINTMENTS: BOARDS AND COMMISSIONS <br /> <br /> On motion by Ms. Daugherty, seconded by Ms. Slaughter, Ms. Diana Frankfurter was <br />unanimously appointed to an unexpired term on the Board of Architectural Review. This <br />term will expire on January 1, 1997. <br /> <br /> On motion by Mr. Vandever, seconded by Ms. Slaughter, Ms. Lisa McConnell and Ms. <br />Deborah Pomerantz were unanimously appointed to three-year terms on the <br /> <br /> <br />
