Edwards, the ordinance was <br />unanimously amended to include the new language about undergrounding <br /> <br /> The ordinance entitled "AN ORDINANCE GRANTING A TELE- <br />COMMUNICATIONS FRANCHISE TO HYPERION TELECOMMUNICATIONS OF <br />VIRGINIA, INC., ITS SUCCESSORS AND ASSIGNS, TO USE THE STREETS AND <br />OTHER PLrBLIC PLACES OF THE CITY OF CHARLOTTESVILLE, VIRGINIA, FOR <br />ITS POLES, ~S, CONDUITS, CABLES, AND FIXTURES FOR A PERIOD OF FIVE <br />(5) YEARS," as amended, which was offered at the October 18th meeting, was approved by <br />the <br /> <br />PUBLIC <br /> <br />There were no matters by the public. <br /> <br />OTHER BUSINESS <br /> <br /> Mr. O'ConneI1 said that 70,000 leaf collection bags have been distributed, and noted <br />that collecting bagged leaves is a more efficient method than the vacuum system. <br /> <br /> Mr. O'Connell announced the completion of the urban water line that connects two <br />major water treatment plants. <br /> <br /> Ms. Slaughter said that in her work at the Southern Environmental Law Center she has <br />been made aware of a list of impaired waters within the Charlottesville-Albemarle area, and <br />recommended that the Council and the Board of Supervisors write to the Department of <br />Environmental Quality to stress the importance of notifying local governments about <br />locations and sources of water problems. <br /> <br />Mr. Vandever encouraged City residents to vote in the election. <br /> <br /> Ms. Daugherty announced a celebration on Wednesday at Westhaven of a <br />beautification program by the Rivanna Garden Club. <br /> <br /> A work session to discuss budget priorities was scheduled for December 8th from <br />12:00 noon to 3:00 p.m. <br /> <br /> On motion by Rev. Edwards, seconded by Ms. Slaughter, Council voted to meet in <br />executive session for the purpose of appointing members to various City boards or agencies, <br />as authorized by Section 2. t-344(A)(1) of the Virginia Code; for the purpose of considering <br />the acquisition or use of real property for public purpose, or the disposition of publicly held <br />property, as authorized by Section 2.1-344(A)(3) of the Virginia Code, and more specifically <br />described as CSX property, property oft'High Street, property north of the 250 Bypass, and <br />lots south of the 250 bypass; and for the purpose of consultation with legal counsel and <br />briefings by staff members, consultants or attorneys concerning two (2) matters pertaining to <br />actual or probable litigation, or other specific legal matters requiting the provision of legal <br />advice by counsel, as authorized by Section 2.1-344(A)(7) of the Virginia Code. <br /> <br /> Council reconvened in open session and, on motion by Ms. Daugherty, seconded by <br />Rev. Edwards, certified, with Mr. Vandever absent for the vote, that, to the best of each <br />member's knowledge, (i) only public business matters lawfully exempted from open meeting <br />requirements by Virginia law were discussed in the executive meeting to which this <br />certification resolution applies, and (ii) only such public business matters as were identified in <br />the motion convening the executive meeting were heard, discussed or considered by the <br />Council <br /> <br /> The meeting was adjourned. <br />President <br /> <br />Clerk(_~ <br /> <br /> <br />
