283 <br /> <br />(2) Preston Avenue, at 4th Street, N.W., for concrete crossing surface <br /> (estimated cost $35,000). <br /> <br /> BE IT FURTHER RESOLVED that the City of Charlottesville hereby agrees to pay <br />its share (10%) of the total costs for preliminary engineering, right-of-way and construction <br />of this project, and that if the City subsequently elects to cancel this project, the City hereby <br />agrees to reimburse the Virginia Department of Transportation for the total amount of the <br />costs expended by the Department through the date the Department is notified of such <br />cancellation. <br /> <br />i. RESOLUTION: Approving h/L4~CAA Special Permit <br /> <br /> WHEREAS, the Monticello Area Community Action Agency, owner of the property <br />at 1025 Park Street, has requested an amendment to the special use permit granted by City <br />Council on January 4, 1993, and amended July 6, 1993, to allow permanent closure of access <br />to the 250 Bypass from 1025 Park Street, and extension of the hours of operation. This <br />property is further identified as Parcel 2 on City Real Property Tax Map 45, having <br />approximately 70 feet of frontage on Park Street, 626 feet of frontage on the 250 Bypass, <br />and containing approximately 343,557 square feet of land or 7.89 acres; <br /> <br /> WHEREAS, following a joint public hearing before this Council and the Planning <br />Comnfission, duly advertised and held on November 14, 1995, this Council finds that such <br />use will conform to the criteria applicable to special permits generally under Chapter 34 of <br />the City Code; now, therefore <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that the <br />special use permit granted to MACAA on January 4, 1993, and amended, July 6, 1993, is <br />hereby amended as follows: <br /> <br /> (I) Access from the property at 1025 Park Street to the 250 Bypass shall be <br />permanently closed. <br /> <br /> (2) ~[ACAA shall not be required to chain off the entrance to 1025 Park Street after <br />the hours of Operation. <br /> <br /> (3) The hours of operation by MACAA or any auxiliary uses shall not exceed t0:00 <br />p.m. on Sunday through Thursday, and 11:00 p.m. on Friday and Saturday. <br /> <br /> The approval of this amendment to the special use permit is conditioned upon <br />administrative approval of the site plan. <br /> <br />j.
