176 <br /> <br />NOW, THEREFORE BE IT RESOLVED, as follows: <br /> <br /> 1. For the reasons set forth above and in greater detail <br />in the letter and report referenced in said letter, (both of <br />which are attached to this Council resolution), it is hereby <br />ORDERED,.that the City does need and shall have a 90 day <br />extension period so as to complete its review of Adelphia's <br />Form 393 filling, <br /> <br /> 2. For those same reasons, the City Manager is hereby <br />authorized and directed to seek additional information from <br />Adelphia by signing and mailing the above described letter and <br />report, in a form approved by the City Attorney, <br /> <br /> 3. The ninety (90) day extension period shall be treated <br />as beginning on January 12, 1994, from which date Adelphia <br />will have thirty (30) days to supply the requested additional <br />information described in the letter and report, and <br /> <br /> 4. The City Manager and the City Attorney are hereby <br />further authorized to send any additional letters and take any <br />reasonable action necessary to bring this regulation~issue back <br />to City Council so that Council's decision as to basic service <br />cable rates can be made in a timely and appropriate manner. <br /> <br />RESOLUTION: GRANTING SPECIAL PERMIT FOR INCREASED DENSITY AT <br />400 E. MAIN STREET <br /> <br /> Mr. Satyendra Huja, Director of Co~unity Development, <br />stated that the Planning Commission recommended approval of <br />the special permit for the following reasons: 1) It is in <br />harmony with the Land Use Plan of the Comprehensive Plan and <br />2) The proposed use will not have a significant adverse impact <br />on the surrounding area if conditions are met. <br /> <br /> On motion by Ms. Daugherty, seconded by Ms. Slaughter, <br />the resolution granting a special permit for increased density <br />at 400 E. Main Street was unanimously approved, with Ms. <br />Slaughter noting that the request is in line with what Council <br />has wanted to happen on the downtown mall. <br /> <br /> WHEREAS, Enterprise Partnership has requested a special <br />use permit for the property at 400 East Main Street and 4th <br />Street, S.E. on the downtown mall, to allow for the addition <br />of a third floor with three (3)two-bedroom dwelling units at <br />a density of 32 dwelling units per acre; this property being <br />further identified as Parcel 45 on City Real Property Tax Map <br />28, having 27.34 feet of frontage on East Main Street <br />(downtown mall), 149.77 feet of frontage on 4th Street, S.E., <br />and containing approximately 4,1198 ~square feet of land or <br />.095 acres; <br /> <br /> WHEREAS, following a joint public hearing before this <br />Council and the Planning Commission, duly advertised and held <br />on December 14, 1993, this Council finds that such use will' <br />conform to the criteria applicable to special permits <br />generally under Chapter 34 of the City Code; now, therefore <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that a special use permit is hereby <br />granted to Enterprise Partnership for the property at 400 East <br />Main Street and 4th Street, S.E. on the downtown mall, to <br />allow for the addition of a third floor with three (3) two- <br />bedroom dwelling units at a density of 32 units per acres. <br /> <br /> The approval of this special use permit is conditioned <br />upon the following: <br /> <br />1. Administrative approval of the site plan. <br /> <br />e <br /> <br />Provision of one handicapped parking space within <br />200 feet of the building. <br /> <br /> <br />
