31 <br /> <br /> Ms. Slaughter stated that she felt it would be important <br />to allow public input into the matter and would recommend <br />that the appeal be made to the Planning Commission, except in <br />emergency situations when the decision could be made by the <br />City Manager. <br /> <br /> Ms. Waters recommended that the decision regarding <br />sidewalk waivers be made by the Planning Commission, with the <br />appeal to the City Council. <br /> <br /> On motion by Ms. Slaughter, seconded by Ms. Waters, the <br />resolution regarding the tree/sidewalk waiver was approved by <br />Council, with Rev. Edwards absent. <br /> <br /> WHEREAS, the public necessity, convenience, general <br />welfare and good zoning practice require the City Council to <br />consider certain amendments to the zoning regulations <br />contained in sections 34-857, 34-143 and 34-173 of Chapter 34 <br />of the Code of the City of Charlottesville~ and, <br /> <br /> WHEREAS, the proposed amendment to City Code section <br />34-857, attached hereto, will further the public safety and <br />welfare by specifying standards and procedures for the <br />removal of potentially dangerous trees; and, <br /> <br /> WHEREAS, the proposed amendments to section 34-143 and <br />34- 173, attached hereto, promote good zoning practices by <br />allowing for review of decisions regarding the waiver of <br />required sidewalks, curbs and gutters; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Charlottesville, Virginia that the Planning <br />Commission is hereby requested to consider, after a joint <br />public hearing, the attached proposed amendments to sections <br />34-857, 34-143 and 34-173 of the City Code, 1990, as amended, <br />and make recommendations to the City Council. <br /> <br />ORDINANCE: CONVEYING PROPERTY ON LANE ROAD TO U. VA. <br /> <br /> On motion by Ms. Waters, seconded by Mr. Vandever, the <br />ordinance entitled "AN ORDINANCE TO AUTHORIZE THE CONVEYANCE <br />OF TWO PARCELS OF LAND ON LANE ROAD TO THE UNIVERSITY OF <br />VIRGINIA" was offered and carried over to the next meeting <br />for consideration. <br /> <br />PUBLIC <br /> <br />There were no matters by the public. <br /> <br />OTHER BUSINESS <br /> <br /> Mr. Toscano informed Council that the Cable Committee <br />will hold a public,hearing on December 3rd regarding the <br />cable franchising process. Mr. Toscano also urged consumers <br />to contact their federal legislators to encourage their <br />support of bills which would give localities more control <br />over cable companies. <br /> <br /> Mr. Hendrix stated that three special meetings needed to <br />be held in the near future: one with the School Board <br />regarding the upcoming budget, one with state legislators, <br />and a work session on drainage.
