117 <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that Council hereby approves an <br />amendment to the agreement dated October 1, 1969 between the <br />School Board of Albemarle County and the School Board of the <br />City of Charlottesville, as shown in the attached copy of <br />said agreement. Said amendment changes the name of the <br />committee known as the Joint Committee for the Control of the <br />Vocational Technical Center to Center Board. <br /> <br />RESOLUTION: AUTHORIZING EMINENT DOMAIN PROCEEDINGS FOR PEDESTRIAN <br />ACCESS EASEMENT <br /> <br /> Mr. Clyde Gouldman, City Attorney, stated that the <br />resolution would authorize eminent domain proceedings for the <br />City to acquire property near Rivanna Park to be used for a <br />bicycle path, noting that the price for the property is the <br />unresolved issue. <br /> <br /> Responding to a question from Ms. Slaughter, Mr. <br />Gouldman stated that the court proceedings should take three <br />to six months. <br /> <br /> Mr. Vandever moved the resolution and it was seconded by <br />Ms. Waters. <br /> <br /> Ms. Slaughter questioned whether work could begin on the <br />remaining part of the Greenbelt Park and added that the Parks <br />Committee was interested in completing a portion of the Park <br />as soon as possible. Ms. Slaughter also recommended <br />exploring using volunteer work on the Park. <br /> <br /> Ms. Waters questioned whether the portion of the <br />Greenbelt Park nearest to Free Bridge should be started <br />to coordinate with the work being done by the Virginia <br />Department. <br /> <br /> Mr. Huja replied that he work could probably begin prior <br />to the court decision but doubted that work could begin <br />before next fall. <br /> <br /> The resolution authorizing eminent domain proceedings <br />for pedestrian easement access at Greenbelt Park was <br />unanimously approved by Council. <br /> <br /> WHEREAS, the City of Charlottesville, Virginia needs to <br />obtain a permanent easement and right-of-way across property <br />identified as Parcel 144 on City Real Property Tax Map 50, <br />which contains approximately 37,204 square feet, for use as <br />public park land; and <br /> <br /> WHEREAS, bona fide efforts have been made to acquire the <br />property by purchase from the owner, but the efforts have <br />been ineffectual because of the inability to agree on the <br />price or terms of the sale of the easement; and <br /> <br /> WHEREAS, the City has no recourse but to acquire the <br />easement through the exercise of its power of eminent domain <br />as authorized by the Code of Virginia and the Charter of the <br />City of Charlottesville; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Charlottesville, Virginia, that a public necessity is <br />hereby declared to exist for the acquisition of a permanent <br />easement and right-of-way to property identified as Parcel <br />144 on City Real Property Tax Map 50, which contains <br />approximately 37,204 square feet, for use as public park <br />land, as more particularly described on the attached plat <br />prepared by Kirk Hughes & Associates, dated July 1, 1991, in <br />order to fulfill the public purpose of providing public parks <br />within the City; and <br /> <br /> BE IT FURTHER RESOLVED by the Council of the City of <br />Charlottesville, Virginia that the City Attorney is hereby <br /> <br /> <br />
