123 <br /> <br /> Mr. Robbie Bingler, 103-B Welk Place, recommended that <br />the Council approve the ADA Plan and added that he felt the <br />City should continue to try to make improvements for <br />handicapped persons. <br /> <br /> Mr. John Santoski, 2124 Sunset Road, a member of the ADA <br />Advisory Committee, stated that he was~pleased with the <br />transition plan and felt it was important for government to <br />be seen as accessible. Mr. Santoski pointed out that costs <br />will be involved in implementing the plan and recommended <br />that the plan be reviewed periodically. <br /> <br /> As there were no further speakers the public hearing was <br />closed. <br /> <br /> Ms. Slaughter stated that she would like additional <br />information about the ultimate requirements of the ADA. <br /> <br /> Mr. Toscano stated that he felt transportation played a <br />major part in the ADA and recommended that consideration be <br />given,~ perhaps involving the Social Development Commission, <br />to examining whether the current funding for the various <br />transportation providers was the most effective way to use <br />the available money. <br /> <br /> Mr. Herndon stated that the Social Development <br />Commission was asked to respond to the plan but the Advisory <br />Committee has not received a response. <br /> <br />PUBLIC HEARING: ORDINANCE IMPOSING PENALTIES ON PROPERTY OWNERS <br />FOR REPEATED CODE VIOLATIONS <br /> <br /> Mr. Gouldman stated that he has provided a revised <br />ordinance which would give notice to property owners of <br />violations bytenants. <br /> <br /> Ms. Pat Drewer, 2920 Woodland DriVe, stated that~ she <br />supported the proposed ordinance because of problems, <br />especially noise violations, on rental properties. <br /> <br /> Ms. Beth Kariel, 2543 Woodland Drive, supported the <br />proposed ordinance~ adding that she felt the City needed to <br />adopt and enforce stronger laws. <br /> <br /> Mr. David Lee, 2516 Woodland Drive,- stated that he <br />favored the ordinance or something similar to it to use as <br />leverage in dealing with ongoing and protracted conflicts <br />involving rental properties. <br /> <br /> Mr. LeRoy Bruton, Route 5, Box 318, stated that he did <br />not think additional legislation is the answer to every <br />problem. Mr. Bruton stated that he felt the proposed <br />ordinance would require sending out many notices and time <br />spent identifying the culprits. Mr. Bruton stated that he <br />felt enforcement of existing laws was needed and added that <br />he felt it was ludicrous to hold property owners responsible <br />and he did not think there was enabling legislation to allow <br />the City to adopt the proposed ordinance. <br /> <br /> Mr. Richard Jones, Management Services Corporation, <br />stated that the Blue Ridge Apartment Council has reviewed the <br />proposed ordinance but felt that instead of adopting such an <br />ordinance the City should find better tools to enforce <br />current laws. <br /> <br /> Mr. Toscano questioned whether the leases used by <br />Management Services has a provision to allow a tenant to be <br />evicted if violations regarding trash, weeds or noise <br />occur. Mr. Jones stated that the leases contain a general <br />phrase which requires tenants to abide by local regulations <br />and includes a noise requirement, but no tenants have been <br />evicted for failure to abide by such regulations to date. <br /> <br /> <br />
