After the sale or conveyance of such <br />properties, said $15,000 bond shall be returned to the City <br />Treasurer. <br /> <br />APPROPRIATION: $1,500 - SIDEWALK CONSTRUCTION <br /> <br /> On motion by Ms. Waters, seconded by Mr. Vandever, the <br /> ~1,500 appropriation for Sidewalk construction was offered <br /> and carried over to the next meeting for consideration. <br /> <br />RESOLUTION: APPROVING AMERICANS WITH DISABILITIES (ADA) PLAN <br /> <br /> Mr. Jim Herndon, Planner in Community Development and a <br />member of~ the ADA Advisory~Committee, reviewed the proposed <br />ADA Plan and the recOmmended changes made by the Planning <br />Commission. <br /> <br /> Mr, Vandever questioned how "budgetary constraints" and <br />"within reason" were defined. <br /> <br /> Mr. Gouldman proposed, that the City's Plan use the <br />actual language of the federal act since he felt the body of <br />law is still being developed and recommended that the City <br />follow what is required and no more at this time. <br /> <br /> Ms. Slaughter requested clarification on the amount <br />needed for accessibility at the Pen Park clubhouse and Mr. <br />Herndon estimated that the amount was $30,000. <br /> <br /> On motion by Ms. Waters, seconded by Ms. Slaughter, <br />Council unanimously approved the ADA Plan, with changes <br />recommended by Mr. Gouldman and the Planning Commission. <br /> <br />ORDINANCE: CEMETERY FEES (2nd reading) <br /> <br /> The ordinance entitled "AN ORDINANCE AMENDING SECTION <br />7-5 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS <br />AMENDED, RELATED TO THE OPENING OF GRAVES," which was offered <br />at the May 18th meeting, was approved by the following vote. <br />Ayes: Rev. Edwards, Ms. Slaughter, Mr. Toscano, Mr. <br />Vandever, Ms. Waters. NOes: None. <br /> <br />ORDINANCE: UTILITY RATES (2nd reading) <br /> <br /> Mr. Vandever questioned whether the Council had the <br /> flexibility~to change the base rate dUring the year and Mr. <br /> Gou!dman replied that there is no legal restriction on when <br /> the rate is changed~ ~ <br /> <br /> Ms. Rita Scott, Director of Finance, stated that rates <br /> could be changed later in the year, and noted that prices <br /> actually fluctuate throughout the year. <br /> <br /> Responding to a question from~Rev, Edwards, Ms. Scott <br /> stated that the City collects an 8% utility tax from <br /> Albemarle County customers, the County receives 2% from the <br /> gas customers and the city customers pay a 10% tax. <br /> <br /> Rev. ~Edwards expressed concern that the City receives <br /> only~8% from the County customers, <br /> <br /> Ms. Slaughter suggested that COuncil consider appointing <br /> an advisory committee, to include one Councilor, to be <br /> charged with hiring a consultant; studying differential rates <br /> between City and County customers, and the feasibility of a <br /> profit built into the rates. <br /> <br /> Ms. Waters expressed concern about establishing another <br />committee for .Councilors to serve on-and recommended that <br />staff focus on defining the questions Which need to be asked <br />and a timeline. <br /> <br /> <br />
