263 <br /> <br />directed prior to commencement of construction of such <br />improvements, to temporarily close portions of the streets <br />within the Willard Drive/Cleveland Avenue area to motor <br />vehicle traffic and to take such actions as he may deem <br />necessary and proper to accomplish such closings for purposes <br />of completing this project. <br /> <br /> G. That the City Attorney is hereby directed to cause <br />to be recorded in the judgment docket of the Clerk's Office <br />of the Circuit Court of the City of Charlottesville an <br />abstract of this resolution in the same or substantially the <br />same form as is attached hereto as Exhibit "A," all as <br />allowed by Virginia Code S. 15.1-247. Such docketing shall <br />be indexed in each of the names of the owners shown on said <br />abstract and shall thereby serve as notice that the subject <br />property is likely to be assessed in an amount and in the <br />manner provided by this resolution. <br /> <br /> H. That the City Attorney is authorized and directed, <br />upon completion of such improvements, when the final costs <br />have been ascertained, to prepare an ordinance for Council's <br />consideration~ and undertake to publish such notices, as may <br />be necessary to complete the imposition of the special <br />assessments referenced in Exhibit "A." <br /> <br /> Mr. Toscano recommended that the City encourage the <br />state legislators to change-~the Code to allow the City to <br />charge a higher interest-rate on such assessments since the <br />City could lose money if the interest rates increase <br />substantially in the future. <br /> <br />ORDINANCE: AMENDING OPEN CONTAINER ORDINANCE (2nd reading) <br /> <br /> Mr. Gouldman stated that the Commonwealth's Attorney had <br />recommended that the ordinance be amended to use "either/or" <br />when defining different types of alcohol and to add "a <br />rebuttable presumption that any beverage which has the <br />appearance and odor of alcohol is an alcoholic beverage for <br />the purposes of this ordinance." <br /> <br /> On motion by Mro Toscano, seconded by Rev. Edwards, the <br />ordinance was unanimously amended as recommended above. <br /> <br /> The ordinance entitled "AN ORDINANCE AMENDING AND <br />REORDAINING SECTION 17-37 OF THE CODE OF THE CITY OF <br />CHARLOTTESVILLE~ 1990~ AS AMENDED, RELATING TO POSSESSION OF <br />OPEN CONTAINERS OF ALCOHOLIC BEVERAGES IN PUBLIC PLACES," as <br />amended, which was offered at the January 4th meeting, was <br />approved by the following vote. Ayes: Rev. Edwards, Mr. <br />Toscanot Mr. Vandever. Noes: None.
