226 <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that a <br />special use permit is hereby granted to Mall Properties, L.L.C., contract purchaser of the <br />property at 112-116 2nd Street, S.W. to place four (4) apartment units on the property, <br />which will require removal of the existing "Pace House"~ This special use permit is <br />conditioned upon the following: <br /> <br />(1) Administrative approval of the site plan. <br /> <br />(2) <br /> <br />Waiver of the service space and handicapped space parking on site requirement <br /> due to space limitations. <br /> <br /> Ms. Richards said there was discussion at the Planning Commission that this was a case <br />of demolition by neglect, and asked if the City can put into place better monitoring of historic <br />structures, such as regular inspections of those structures showing signs of neglect, or <br />otherwise develop a plan or strategy to address the situation. <br /> <br /> Ms. Slaughter says she feels blame for the condition of the structures lies with the City <br />and asked staffto explore a policy to prevent a recurrence. <br /> <br />Mr. O'Connell said staffwill look at the legal issues and what other localities do. <br /> <br />CONSENT AGENDA <br /> <br /> Mr. Toscano referred to the reversion expenses in the year end adjustments, and said <br />that he feels Council needs to have a discussion about the anticipated future expenses, <br />including a breakdown of these expenses, of reversion and a formal vote. Mr. Toscano said <br />the breakdown should include: a formal update on the cost of the Muller update; legal fees, <br />in levels of representation; and the projected cost for all participants in the process so that <br />Council can choose what level to support. <br /> <br /> Responding to a question from Ms. Daugherty, Ms. Peacock said she will check on the <br />amount of funding available in Council reserve. <br /> <br /> Ms. Richards says she feels costs for the school consultant and temporary staff need to <br />be part of the breakdown. <br /> <br /> Responding to questions from Mr. Toscano, Ms. Peacock said $35,000 is budgeted <br />each year for snow related overtime, and $29,000 was recovered for last year's expenses. <br /> <br /> Mr. Toscano asked how decisions are made about court house maintenance, and Ms. <br />Peacock said the funds are included in building maintenance and are made by the City staff <br /> <br /> Mr. Toscano asked for information on how gainsharing funds are used, including gas <br />funds. <br /> <br /> Ms. Slaughter said she feels gas funds may be different and Council may want discuss <br />returning some of these funds to customers. <br /> <br /> Ms. Richards pointed out that the donation from the Charlottesville Downtown <br />Foundation is just part of continuing donations from CDF, primarily derived from profits <br />from Fridays After Five, and is a good example of a public/private partnership. Ms. Richards <br />added that donations for the amphitheater have also been made by NationsBank, State Farm, <br />and the Municipal Band. <br /> <br /> On motion by Ms~ Daugherty, seconded by Mr. Toscano, the following consent agenda <br />items were unanimously approved, with Mr. Cox absent. <br /> <br />a.
