65 <br /> <br /> Ms. Slaughter stated!that approval from the Health <br />Department would be a prerequisite to receiving a permit. <br /> <br /> Council unanimously voted to expand the locations <br />available on the mall for sidewalk cafes. <br /> <br /> Ms. Slaughter stated that she thought the carryout <br />nature of the Hardware Store Restaurant's sidewalk cafe was <br />fine. <br /> <br /> On motion by Ms. Slaughter, seconded by Mr. Toscano, the <br />issue of granting individual permits for sidewalk cafe was <br />unanimously deferred. <br /> <br /> The issue of revoking permits if sidewalk cafes are not <br />used was discussed. Ms. Slaughter made a motion that if <br />cafes are not in use for a year the permit would be lost. <br />Mr. Toscano seconded the motion. <br /> <br /> Mr. Clyde Gouldman, City Attorney, recommended that all <br />cafe permits include a clause allowing Council to revoke a <br />permit within fifteen days if a sidewalk cafe has not used <br />for a period of 30 days. <br /> <br /> Ms. Slaughter and Mr, Toscano agreed to amend their <br />motion to reflect the language recommended by Mr. Gouldman <br />and Council unanimously voted to include the language in all <br />future sidewalk cafe permits. <br /> <br /> Ms. Slaughter requested that staff contact the operator <br />of the Coffee Exchange about her current sidewalk cafe permit <br />since the cafe did not operate at all this year. <br /> <br /> Responding to a question from Mr. Toscano, Mr. Gouldman <br /> stated.that all sidewalk cafe furniture and equipment must be <br /> removed from the mall between November 30th and March 1st to <br /> allow for snow removal. <br /> <br />STAFF REPORT: GOLF COURSE DESIGN <br /> <br /> Mr. Hendrix explained that on May 7th Council reaffirmed <br />the decision to expand the golf~course at Pen Park to 18 <br />holes and requested that the final design be presented ~to <br />Council for review. Mr. Hendrix continued that Council had <br />agreed that accommodations needed to be made to provide space <br />for nature and exercise trails and that regulations regarding <br />wetlands needed to be~followed. ~Mr. Hendrix stated that the <br />final design includes-these considerations. <br /> <br /> Mr. Bill Love, architect for the golf course expansion, <br />explained that the expansion was originally designed to be <br />efficient, playable, ~cost effective and~compatible with the <br />existing nine holes. Mr. Love stated that the original <br />design was altered after concerns were raised about the <br />nature and exercise trails and the wetlands. Mr. Love stated <br />that using the former sewage treatment property or purchasing <br />additional property were not seen as feasible alternatives <br />and the design presented was seen as a workable compromise <br />which would require that one soccer field be relocated. <br /> <br /> Rev. Edwards stated that he would allow one person to <br />speak on behalf of the golf course expansion and one person <br />to speak for those opposed to the expansion. <br /> <br /> Mr. Todd Merkel, speaking on behalf of the sierra Club, <br />Citizens for Albemarle, and the Monticello.Bird Club, <br />complained that citizens were not being given ample <br />opportunity to make comments about the proposal. Mr. Merkel <br />presented a petition signed by 1,320 persons in opposition to <br />the golf course expansion into the natural areas of the Park. <br />Mr. Merkel urged Council-to relocate holes 11 and 112 away <br /> <br /> <br />
