49 <br /> <br /> Mro Fran Lawrence of 1729~Chesapeake Street, and counsel <br />to the Woolen Mills Neighborhood Association, presented a <br />resolution expressing concernlabout removing a residential <br />building from use as a single family residence, but adding <br />that the neighborhood would agree to the special permit with <br />conditions regarding operating hours, BAR review, site <br />conditions and future expansion. <br /> <br /> Ms. Susan Winslow, Director of the Adult Day Care <br />Center, stated that it would be preferable to allow <br />occasional night and weekend use. Ms. Winslow added that <br />increasing the cost of construction might make the rent <br />prohibitively high. <br /> <br /> Mr. Clyde Gouldman, City Attorney, stated that the <br />building in question has not been declared an historic <br />structure. <br /> <br /> Ms. Peggy Van Yahres, a resident of Chesapeake Street <br />and a member of the BAR, explained that the BAR has made no <br />formal recommendations regarding the proposed renovation and <br />construction. <br /> <br /> Mr. Hurt agreed to have the property be subject to BAR <br />review for purposes of the special permit only, adding that <br />he would not agree to the BAR review requirement should the <br />special permit be denied. <br /> <br /> Mr. Tom Parmenter of 1506 E. Market St., stated that he <br />would not favor use of the building by other groups and would <br />prefer that the parking site be relocated, but nOted that he <br />did~not care whether the roof~was tin. <br /> <br /> It was noted that no expansion would be allowed without <br />amending the special permit. <br /> <br /> It was agreed that evening and Saturday use would be <br />restricted to four occasions per month. <br /> <br /> On motion by Mr. Vandever, seconded~by Mr. Buck, the <br />resolution granting the special permit for an adult day care <br />center at 1215 E. Market St. was unanimously approved by <br />Council. <br /> <br /> WHEREAS, Blake Hurt, President of Republic Capital <br />Corporation, has requested a special permit to'allow use of <br />the structure and R-2 portion of the property at 1512 East <br />market Street for an adult day care center, such property <br />being further identified on City Real'Property Tax Map ~56 as <br />a portion of parcel 40.4, having approximately 154.6 feet of <br />frontage on East Market Street, and containing approximately <br />100,188 square feet of land, or 2.3 acres; <br /> <br /> WHEREAS, following a joint public hearing before this <br />Council and the Planning Commission, duly advertised'and <br />held on May 9, 1989, this Council finds that such use will <br />conform to the criteria applicable to special permits <br />generally under Chapter 31 of the City Code; now, therefore, <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that the special permit is hereby <br />granted to Republic Capitat Corporation .to allow use of the <br />structure and R-2 portion of the property at 1512 East Market <br />Street for an adult day care center, pursuant to City Code <br />Section 31-21. ~ .... <br /> <br /> This special permit ~is granted subject ~to the following <br />cOnditions:~ ~ <br /> <br /> 1.
