66 <br /> <br /> WHEREAS, the City and County haVe contracted with a <br /> private contractor who is properly bonded to perform the <br />above described work according to Virginia Department of <br /> Transportation ("VDOT") standards; and <br /> <br /> WHEREAS, VDOT requires that at least one of. the joint <br /> owners guarantee the completion-of all necessary work within <br /> the public right-of'way; and <br /> <br /> WHEREAS, the City in the interest of getting the <br /> construction.started as soon as practicable, and in light of <br /> the last described bonded performance of the private <br /> contractor, is willing to make such a guarantee, now <br /> therefore <br /> <br /> BE IT RESOLVED that the Council of the City oft <br /> Charlottesville in behalf of the City hereby guarantees to <br /> VDOT that all work required in conjunction with the above <br /> project will be completed in accord with VDOT standards. <br /> <br />RESOLUTION: GUARANTEEING VA. DEPT. OF TRANSPORTATION CERTAIN <br />RIGHTS-OF-WAY AND EASEMENTS IN CONNECTION WITH RIVANNA PARK ACCESS <br />ROAD <br /> <br /> On motion by Rev. Edwards, seconded by Mr. Towe, the <br />resolution guaranteeing the Virginia Department of <br />Transportation certain rights-of-way and easements in <br />connection with Rivanna Park access road was approved by <br />Council, with Mr. Buck absent for the vote. <br /> <br /> WHEREAS, the City Of Charlott~esVille (the "City") and <br />Albemarle County (the "County") are j0intlY construCting an <br />entrance for Rivanna Park along State Routes 20 and 1421; and <br /> <br />WHEREAS, the Virginia Department of Transportation <br />("VDOT") has requested that rightS-of-way recentlY acquired <br />by the City and County be deeded to VDOT or that, <br />alternatively, a joint resolution guaranteeing VDOT an <br />unobstructed right-of.way be adopted befOre a permit for <br />construction can be issued; and <br /> <br /> WHEREAS, it is thought that adoption of such a <br />resolution will allow construction to begin sooner; now, <br />therefore <br /> <br /> BE IT RESOLVED that the City and County hereby guarantee <br />to VDOT an unobstructed right-of-Way and sight and drainage <br />easements across that property shown as~parcels X, Y and Z on <br />the shaded area shown on a plat of R°udabush, Gale and <br />Associates, Inc. dated June 1, 1989, which is attached hereto <br />and made a part hereof. <br /> <br /> On motion by Rev. Edwards, seconded by Mr. Towe, Council <br />voted to meet in executive sessiOn to diScuss personnel <br />matters as exempted by Section 2.1-344(a)(1) of the Virginia <br />Freedom of Information Act. <br /> <br /> FOlloWing executive session~CounCil recOnvened in open <br />session. · <br /> <br /> On motion by Mr. Buck, seconded by Mr. Towe, Mr. John <br />Pezzoli and Mr. Rauzelle Smith were unanimously reappointed <br />to three-year terms on the School Board. These terms will <br />expire on'June 30, 1992. <br /> <br />The meeting was adjourned. <br /> <br /> <br />
