Edwards, Mr. Towe,
Mr. Vandever.

LEGAL BASIS FOR COMPREHENSIVE PLAN

Mr. Clyde Gouldman, City Attorney, explained that the
physical development portion of the Comprehensive plan is
required by State law to be reviewed and adopted every five
years. Mr. Gouldman stated that the Plan should be general
in nature and is used to advise Council on future physical
development decisions.

LAND USE PLAN

Mr. GOuldman stated that a public hearing is required to
be held by Council on the proposed ComprehensiVe Plan and if
Council amends the Plan it must be sent back to the Planning
Commission for their review prior to final adoption by City
Council. Mr. Gouldman stated that prior to making changes
to the Comprehensive Plan Council should consider the
following: 1) What are the objectives behind the proposed
changes? 2) Does Council agree with those objectives? and
3) Are the objectives accomplished by the proposed changes?

Mr. Craig Brown, Deputy City Attorney, discussed the
issue of downzoning and recommended that in order to be
legally defensible there needed to be consistency in the
existing zoning and the proposed Plan. Mr. Brown stated that
the major change in classification recommended was to create
a new R-lA (single family) zone. Mr.,Brown stated that as
many as 5,000 parcels of land could be affected by Zoning
changes, many of them by downzoning. It was pointed out that
creating the new single family zone would not autOmatiCally
downzone property. Mr. Brown stressed that it was important
when rezoning to be comprehensive and to be able to justify
the change. ~

Mr. Huja reviewed the areas proposed for a change of
zoning in the Comprehensive Plan and listed the following
criteria used for recommending changes: '1) if the zoning was
R-1 no changes were recommended; 2) the present use of the
area was considered; 3) it was felt that single family zoning
should be diStributed throughout the City; 4) single family
zoning should exist in all. socio-economic areas of the City;
and 5) the lot size was considered.
