142 <br /> <br /> Responding to a suggestion by Mr. Huja that a wood fence <br />be built on top of the rock wall, Mr. Shifflett, owner of the <br />property, objected to this requirement. <br /> <br /> Mr. Huja stated that he would not object to having only <br />the rock wall if it was three-feet tall. <br /> <br /> On motion by Mr. Buck, seconded by Mr. Vandever, Council <br />unanimously authorized the encroachment on Monticello Avenue <br />for a three-foot rock wall. <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville that the Mayor is hereby authorized to <br />execute on behalf of the City, in form approved by the City <br />Attorney, the following document: <br /> <br />Consent of Encroachment between William and <br />Caroline Shifflett and the City to acknowledge <br />an encroachment into the Monticello Avenue <br />right-of-way at 906 Monticello Avenue <br /> <br /> A copy of such document shall be kept on file with the <br />minutes of the Council meeting at which this resolution was <br />adopted. <br /> <br />RESOLUTION: APPROVING TRANSFER OF $60,000 TO MCINTIRE PARK <br /> <br /> Mr. Hendrix stated that the resolution would transfer <br />$60,000 previously approved for a wildlife exhibit at Pen <br />park to the McIntire Park renovation project. <br /> <br /> On motion by Rev. Edwards, seconded by Mr. Towe, the <br />resolution approving the transfer of $60,000 to McIntire Park <br />was unanimously approved by Council. <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia, that the sum of $60,000, which <br />previously had been earmarked for a wild animal zoo at Pen <br />park, is hereby transferred from account 26-171-073111 in the <br />Capital Projects Fund to account 26-173-121050 in the same <br />Fund. <br /> <br />PUBLIC <br /> <br />There were no matters by the public. <br /> <br />OTHER BUSINESS <br /> <br /> Mr. Towe announced that December 6th would be declared <br />"Miss Ora Day" in honor of the retirement of Miss Ora Maupin, <br />Commissioner of Revenue. <br /> <br /> On motion by Mr. Vandever, seconded by Rev. Edwards, <br />Council unanimously voted to meet in executive session for <br />the purpose of considering the acquisition or use of real <br />property for public purpose, or the disposition of publicly <br />held property, as authorized by .Section 2.1-344(a)(3) of the <br />Virginia Freedom of Information Act, or more specifically ~ <br />described as three different properties in the downtown area. <br /> <br /> Council reconvened in open session and on motion by Rev. <br />Edwards, seconded by Mr. Vandever, unanimously certified that <br />to the best of each member'~s knowledge, (i) only public <br />business matters lawfully exempted from open meeting <br />requirements by Virginia law were discussed in the executive <br />meeting to which this certification resolution applies, and <br />(ii) only such public business matters as were identified in <br />the motion convening the executive meeting were heard, <br />discussed or considered by the Council. <br /> <br /> The meeting was adjourned. <br />Pro~nt <br /> <br /> <br />
