ORDINANCE: PARK CLOSING HOURS (2nd reading) The ordinance entitled "AN ORDINANCE AMENDING AND REORDAINING SECTION 18-3 OF THE CODE OF .THE CITY OF . CHARLOTTESVILLE, 1976,..AS AMENDED, TO INCLUDE CLOSING HOURS FOR PEN PARK," which was offered at the MaY 21st meeting, was approved by the following vote. Ayes: Mr. Buck, Rev. Edwards, Mr.- Towe, Mr.., Vandever., Ms~. Waters. ~ Noes: . None. ORDINANCE: REZONING PROPERTY AT CORNER OF ST. CLAIR AND LONG STREET FROM R-2 TO B-1 Mr. Buck Stated that he would abstain from discussing the rezoning due to a potential-conflict ~of interest. Mr. Huja stated that the Planning Commission recommended denial of the rezoning because of the increased traffic on the surrounding neighborhood streets. Responding to a question from Rev. Edwards, Mr. Huja replied that three duplexes could be built on the property by right. Rev. Edwards expressed frustration over the decision because of the difference of opinion in the neighborhood. The attorney for the applicant stated that he .felt that the more realistic traffic count was 160 trips per day rather than 342 because of the nature of the doctor's office. Ms. Waters noted that even if the traffic count was less than generally anticipated, the rezoning would allow other uses as well which could generate more traffic. Mr. Towe noted that Mr. Blake Caravati, Planning Commission member, had indicated that he would have voted in favor of the rezoning had he known about the change in size. Mr. Towe stated that he felt it was an outstanding proposal. Mr. Terry Tereskerz, from the Locust Avenue neighborhood, stated that the neighborhood's executive committee and the Locust Grove and Martha Jefferson Hospital Neighborhood Associations all oppose the rezoning. Ms. Waters stated that she would not vote in favor of the rezoning because she did not feel there was a good way in and out of the property that~would not negatively impact the neighborhood. On motion by Mr. Towe, seconded by Mr. Vandever, the ordinance entitled "AN ORDINANCE AMENDING AND REENACTING THE DISTRICT MAP INCORPORATED IN SECTION 31-4 OF THE ZONING ORDINANCE OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, AS AMENDED, BY THE REZONING OF PROPERTY LOCATED AT THE NORTHEAST CORNER OF ST. CLAIR AVENUE AND LONG STREET" was offered and carried over to the next meeting, with Mr. Vandever acknowledging that he had similar concerns to Ms. Waters regarding traffic.
