This resolution shall take effect immediately upon <br /> its adoption. <br /> <br />ORDINANCE: PARK CLOSING HOURS (2nd reading) <br /> <br /> The ordinance entitled "AN ORDINANCE AMENDING AND <br /> REORDAINING SECTION 18-3 OF THE CODE OF .THE CITY OF . <br /> CHARLOTTESVILLE, 1976,..AS AMENDED, TO INCLUDE CLOSING HOURS <br /> FOR PEN PARK," which was offered at the MaY 21st meeting, was <br /> approved by the following vote. Ayes: Mr. Buck, Rev. <br /> Edwards, Mr.- Towe, Mr.., Vandever., Ms~. Waters. ~ Noes: . None. <br /> <br />ORDINANCE: REZONING PROPERTY AT CORNER OF ST. CLAIR AND LONG <br />STREET FROM R-2 TO B-1 <br /> <br /> Mr. Buck Stated that he would abstain from discussing <br /> the rezoning due to a potential-conflict ~of interest. <br /> <br /> Mr. Huja stated that the Planning Commission recommended <br />denial of the rezoning because of the increased traffic on <br />the surrounding neighborhood streets. <br /> <br /> Responding to a question from Rev. Edwards, Mr. Huja <br />replied that three duplexes could be built on the property by <br />right. <br /> <br /> Rev. Edwards expressed frustration over the decision <br />because of the difference of opinion in the neighborhood. <br /> <br /> The attorney for the applicant stated that he .felt that <br />the more realistic traffic count was 160 trips per day rather <br />than 342 because of the nature of the doctor's office. <br /> <br /> Ms. Waters noted that even if the traffic count was less <br />than generally anticipated, the rezoning would allow other <br />uses as well which could generate more traffic. <br /> <br /> Mr. Towe noted that Mr. Blake Caravati, Planning <br />Commission member, had indicated that he would have voted in <br />favor of the rezoning had he known about the change in size. <br />Mr. Towe stated that he felt it was an outstanding proposal. <br /> <br /> Mr. Terry Tereskerz, from the Locust Avenue <br />neighborhood, stated that the neighborhood's executive <br />committee and the Locust Grove and Martha Jefferson Hospital <br />Neighborhood Associations all oppose the rezoning. <br /> <br /> Ms. Waters stated that she would not vote in favor of <br />the rezoning because she did not feel there was a good way in <br />and out of the property that~would not negatively impact the <br />neighborhood. <br /> <br /> On motion by Mr. Towe, seconded by Mr. Vandever, the <br />ordinance entitled "AN ORDINANCE AMENDING AND REENACTING THE <br />DISTRICT MAP INCORPORATED IN SECTION 31-4 OF THE ZONING <br />ORDINANCE OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, <br />AS AMENDED, BY THE REZONING OF PROPERTY LOCATED AT THE <br />NORTHEAST CORNER OF ST. CLAIR AVENUE AND LONG STREET" was <br />offered and carried over to the next meeting, with Mr. <br />Vandever acknowledging that he had similar concerns to Ms. <br />Waters regarding traffic. <br /> <br /> <br />
