Public RESOLUTION: APPROVING oUTDoOR CAFE FOR CHUBBY'S REsTAuRANT Mr. Hendrix stated that the'MayOr had requested that Council reconsider the resolution approving an outdoor cafe for Chubby's Restaurant since an agreement had been worked out between the owners and Charlottesville Downtown Foundation (CDF) not to have the cafe in operation during Fridays After Five. Mr. Hendrix noted that the design of the cafe has not yet been approved by the Board of Architectural. Rev. Edwards stated that he previously abstained on the matter since the owners and CDF had nOt discussed the matter. Mr. Toscano recommended that the resolution be amended to restrict the hours the cafe is not in operation only to those times when Fridays After Five is in its current location on the west.end of'the mall. Ms. Slaughter stated that she continUed to be concerned about the distance from the kitchen to the cafe and asked if the cafe could be located 'to the west of the Nook Cafe which would be closer to the building occupied by .Chubby's. .Mr..Huja 'stated thlat ~he fire lane was in the location suggested bY Ms Slaughter and he was 'uncertain whether it could be relocated. Ms. waters added that there are.no trees to the west of the Nook's Cafe which would make the location leSs deSirable. Ms. Waters stated that she shared the concern about the distance of the cafe from the kitchenl, but had come to the conclusi°n that as long as the cafe is in the same blOck as the restaurant she will support the cafe. Ms. Waters suggested that staff revisit the recommended cafe locations which are currently designated to determine whether any conditions exist which might make some of them unsuitable.
