96 <br /> <br /> Mr. Huja stated that the Planning Commission had <br />discussed the matter at a work session and recommended <br />approval of the special permit with the restriction <br />described above. <br /> <br /> On motion by Mrs. Gleason, seconded by Dr. Hall, <br />Council unanimously voted to grant the special permit to <br />allow subdivision of 423-425 North First Street. <br /> <br /> WHEREAS, First Street Property Associates has requested <br />a special permit for higher residential density on the <br />property located at 423 North First Street and 425 North <br />First Street, being further identified on City Real Property <br />Tax Map ~33 as parcel 104, having approximately 160.25 feet <br />of frontage on North First Street and containing <br />approximately 14,252 square feet of land or .33 acres; and <br /> <br /> WHEREAS, following a joint public hearing before this <br />Council and the Planning Commission, duly advertised and held <br />on February 9, 1988, this Council finds that such use will <br />conform to the criteria applicable to special permits <br />generally under Chapter 31 of the City Code~ now, therefore <br /> <br /> BE IT RESOLVED by the Council of the City of <br />Charlottesville, Virginia that the special permit is hereby <br />granted to allow a density of 43 units/acre at 423 North <br />First Street and 33 units/acre at 425 North First Street with <br />the existing side yards of zero and with the existing <br />building separation of 4 feet. <br /> <br /> BE IT FURTHER RESOLVED that this special use permit is <br />limited so that the applicant, its successors, and assigns, <br />are hereby prevented from restoring any structure now located <br />on the subject property which suffers damage or destruction <br />in an amount that exceeds fifty percent of the structureJs <br />appraised value unless such structure, as restored, conforms <br />to all zoning and other land use laws then applicable to new <br />construction. For purposes of this resolution, "appraised <br />value" means that assessed value given the property by the <br />City Assessor immediately prior to the damage or destruction. <br /> <br /> This special use permit is also subject to the following <br />conditions: <br /> <br /> 1) There shall be developed recreational space <br />totalling at least 295 square feet on the 423 First Street <br />site. <br /> <br /> 2) There shall be frontage landscaping along both sites <br />which shall include additional trees and other appropriate <br />plantings. <br /> <br /> 3) At least 3 square feet of storage area, other than <br />in the dwelling unit, shall be provided for each bedroom at <br />425 North First Street. <br /> <br /> 4) Laundry facilities shall be provided for 425 North <br />First Street either in each unit or ina common facility in <br />the basement. <br /> <br />RESOLUTION: PROCLAIMING CDBG WEEK <br /> <br /> Ms. Cindy Stratton, Chairman of the CDBG Task Force, <br />requested that Council proclaim April 2 - 9th as CDBG Week. <br /> <br /> On motion by Dr. Hall, seconded by Mrs. Gleason, <br />Council unanimously proclaimed April 2 - 9th as CDBG Week. <br /> <br />RESOLUTION: AUTHORIZING GYPSY MOTH PROGRAM <br /> <br /> Mr. Gene German, Director of Parks and Recreation, <br />described the Appalachian Integrated Pest Management <br />Demonstration Project, a federally funded gypsy moth survey <br /> <br /> <br />
