• <br />• <br />• <br />5. <br />(b) The membership of any person in the plan shall cease upon: <br />Termination of service as an employee prior to the completion of <br />five years of creditable service; or <br />Retirement; or <br />Death. <br />When membership ceases, except in the case of retirement or of death under <br />circumstances calling for the payment of benefits hereunder, an employee shall thereafter <br />lose all right to any retirement allowance or benefits under this article arising from service <br />prior to the date of such cessation of membership except for any deferred retirement <br />benefits such employee might be entitled to receive, provided that if any such employee <br />should subsequently again be in service, the provisions of this subsection shall be <br />inapplicable to his previous period or periods of creditable service. <br />SECTION 2-219.4. Service retirement. <br />(a) Any member who is in service at his normal retirement date may then retire, or <br />may then be retired by his appointing authority, upon written notification to the commission <br />made by the member or by his appointing authority setting forth at what date the retirement <br />is to become effective; provided, that such e ffective date shall be after the member's last <br />day of service and shall not be more than ninety days prior to the filing of such <br />notification. <br />(b) No member shall be permitted to continue in service after his normal retirement <br />date except with the approval of his appointing authority. The commissioner of the revenue, <br />city treasurer, city sheriff, clerk of the circuit court, and commonwealth's attorney, who <br />by definition under section 2 -219.1 have no appointing authority, may continue in service <br />in such offices after their normal retirement date, provided that their average final <br />compensation and creditable service shall both be fixed as of such normal retirement date <br />and shall not be increased on account of such continued service thereafter. Any member <br />who continues in service beyond his normal retirement date may retire, or may be retired <br />by his appointing authority, at any time thereafter, upon written notification to the <br />commission, made by the member or by his appointing authority, setting forth at what date <br />the retirement is to become effective; provided, that such effective date shall be after <br />the member's last day of service and shall not be more than ninety days prior to the filing <br />of such notification. <br />(c) Any member who is in service and who has completed five or more years of <br />creditable service may retire at any time within the five -year period immediately <br />preceding his normal retirement date upon written notification to the commission, made <br />
