i <br />AN ORDINANCE TO ESTABLISH CURFEW HOURS <br />FOR MINORS UNDER CERTAIN AGES, TO PROVIDE CERTAIN <br />EXCEPTIONS THERETO AND TO ESTABLISH THE <br />• RESPONSIBILITIES OF PARENTS AND OTHER ADULTS <br />WITH RESPECT TO SUCH CURFEW <br />BE IT ORDAINED by the Council of the City of Charlottesville: <br />SECTION 1. CURFEW FOR MINORS UNDER EIGHTEEN YEARS OF AGE - <br />HOURS OF CURFEW. <br />(a) Except as provided in section 4, it shall be unlawful for <br />any person under the age of eighteen years to drive, ride in or <br />occupy any motor vehicle, on any public street or highway, or any <br />other public property or public place, or on any private property not <br />owned by or under the control of such person or his parent, guardian <br />or other adult having the care of custody of such person, between the <br />hours of 1:00 a.m, and 5:00 a.m. <br />(b) Except as provided in section 4, it shall be unlawful for <br />any person under the age of fifteen years to be in or upon the <br />streets or public parks of the city, or on any other public property <br />or public place, or on any private property not owned by or under <br />the control of such person or his parent, guardian or other adult <br />having the care or custody of such person, between the hours of <br />11:00 p.m. and 5:00 a.m. <br />• <br />SECTION 2. SAME - RESPONSIBILITIES OF OWNERS AND OPERATORS <br />OF VEHICLES. <br />It shall be unlawful for the owner or operator of any motor <br />vehicle to knowingly permit a violation of section 1(a). <br />SECTION 3. SAME - RESPONSIBILITIES OF PARENTS, GUARDIANS, ETC. <br />It shall be unlawful for any parent, guardian or other adult <br />having the care or custody of any person under the age of eighteen <br />years to permit any such person to violate any of the provisions <br />of section 1(a) or section 1(b). <br />SECTION 4. SAME - EXCEPTIONS. <br />The provisions of section 1 shall not apply to any person <br />under eighteen years of age who is accompanied by his parent, <br />guardian or other adult having the care or custody of such person, <br />or when such person under eighteen years of age is upon legitimate <br />business approved by written permission of his parent, guardian or <br />other adult having the care or custody of such person. <br />• SECTION 5. SAME - PENALTY. <br />Violation of any of the foregoing sections shall be deemed a <br />misdemeanor, punishable as provided in section 1-5 of the City Code. <br />
